With between 12 and 23 inches <br />of unsaturated soil, fecal coliforms cannot exceed 1,000 colonies per 100 ml above background <br />levels before discharged into the soil. With between 24 and 35 inches of unsaturated soil, fecal <br />coliforms cannot exceed 10,000 colonies per 100 ml above background levels before discharged <br />into the soil. <br />N. Part 7080.0315,subp.1. is deleted. <br />0. Part 7080.0315, subp.3.C.(1) is amended to read: An inspection report for existing systems shall <br />include the methodology used to determine vertical separation, tank leakage, and whether an <br />imminent threat to public health or safety exists. <br />P. Part 7080.0315 is amended to add subp.3.C. to read: New Construction, replacement and existing <br />systems.(1) If a system is evaluated by two or more licensed designers with at least one of the <br />designers being a licensed inspector, the vertical separation requirement will remain valid for the life <br />of the system.(2) As part of the evaluation, verification of the vertical separation must be made by <br />in -field measurements of the redoximorphic features determined and documented during the <br />original soil testing or by documentation of in -field measurements of the redoximorphic features and <br />the inplace systems determined during a construction inspection. <br />Q. Part 7080.0450,subp.1 is amended to read: Adoption and use. Warrantied individual sewage <br />treatment systems meeting the requirements under this part may be employed if pretreatment is <br />provided; but effluent filters are not considered pretreatment. <br />4.00 VIOLATIONS AND PENALTIES <br />4.01 Misdemeanor. Any person who fails to comply with the provisions of this ordinance may be charged with a <br />misdemeanor and upon conviction thereof, shall be punished therefore, as provided by law. A separate <br />offense shall be deemed committed upon each day during or on which a violation occurs or continues. <br />4.02 Injunctive Relief. In the event of a violation or a threat of violation of this ordinance, the Department may <br />institute appropriate actions or proceedings to include injunctive relief to prevent, restrain, correct or abate <br />such violations or threatened violations; and the County Attorney may institute a civil action. <br />4.03 Civil Action. In the event of a violation of this ordinance, the County may institute appropriate actions or <br />proceedings to include injunctive relief to prevent, restrain, correct, or abate such violations, or threatened <br />violations, and the County Attorney may institute such action. <br />5.00 EFFECTIVE DATE <br />5.01 This ordinance shall be effective immediately upon passage by the County Board. <br />Ord.
