<br />Councilmember McGlone asked if the City could purchase the properties now on a Contract for <br />Deed with a balloon or have some type of a lease back with the current owner. <br /> <br />Public Works Director Olson stated staff needed to determine if the project was prefunded, <br />would MSA reimburse the City and could the City lease back the property and still have the <br />project considered for MSA funding. <br /> <br />Councilmember Dehen stated he would like to determine the interest of the property owners if <br />the owners wanted to sell. <br /> <br />Chairperson Elvig asked staff to look at other properties in that area for sale to obtain a baseline <br />price for the properties. <br /> <br />Councilmember McGlone believed the Council needed to determine what alignment should be <br />used. <br /> <br />Public Works Director Olson responded it would be good to know the Council's intent with <br />respect to alignment prior to contacting the neighborhood. <br /> <br />Councilmember Elvig noted it was important to have this area accessible to Central Park also. <br /> <br />Chairperson Elvig stated he had an issue with homes emptying out onto a State Aid Road. on <br />Willemite. <br /> <br />Councilmember McGlone agreed with Chairperson Elvig. <br /> <br />City Engineer Himmer responded they could realign this road to the west side of the properties <br />and Willemite would become a frontage road. <br /> <br />Public Works Director Olson stated staff would bring more clarification on the Commission's <br />questions and concerns to the next meeting. <br /> <br />Case #3: <br /> <br />Indemnification of Property Owner Installed Septic Systems <br /> <br />City Engineer Himmer reviewed the staff report. <br /> <br />Councilmember Dehen did not believe the City had any liability for a private septic systems and <br />he did not know why there was the need for an indemnification agreement. He asked staff to <br />obtain the City Attorney's opinion regarding why an indemnification agreement was needed. <br /> <br />Deputy City Administrator Nelson noted there were risks regarding contaminating the <br />groundwater with septic systems if septic systems were allowed to be installed by individuals. <br /> <br />Councilmember McGlone stated because a septic system was dealing with raw sewage, he was <br />okay with requiring indemnification agreements. <br /> <br />Public Works Committee / September 15, 2009 <br />Page 4 of 6 <br />
