Absent: Councilmember Elvig. <br /> <br />Case #3: <br /> <br />Consider Award of Contract for City Project #08-21, Water Tower #3 at <br />16600 St. Francis Boulevard <br /> <br />Mayor Ramsey noted that Councilmember Elvig is on his way to the meeting and would like to <br />have discussion on this case postponed until he arrives. <br /> <br />Case #4: <br /> <br />Consider Award of Contract for City Project #08-27, 167th Avenue NW <br />Realignment <br /> <br />City Engineer Himmer reviewed the staff report. He noted that the question for the Council to <br />consider is whether to construct this with a trail or a sidewalk because of the trees in the area. <br /> <br />Mike Ellis, 7001 - 166th Avenue NW, stated that he owns the trees in the area and they are <br />significant. He reviewed some of the tactics he has taken in preventing cars cutting this comer, <br />by putting in rocks and fencing in addition to the trees. He stated that if there needs to be two <br />feet between the walking trail and the fencing it would really pack things in tight and noted that <br />he doesn't want to lose the screening he has with the big trees in the front. He asked that the <br />Council shrink this down to a sidewalk so he isn't as significantly impacted as he would be with <br />a trail. He noted that the trees are too big to be transplanted. <br /> <br />Councilmember Wise stated that he wants to make sure that the City stays far enough away from <br />the trees so there is no impact to the root system. <br /> <br />City Engineer Himmer stated that there should be minimal damage and noted that they spoke to a <br />landscape expert about the project who agreed. He stated that he agrees with Mr. Ellis that it will <br />be a very tight fit. <br /> <br />Councilmember Dehen asked what precedent this would set for other property owners that don't <br />want the City to take out their landscaping if the City puts in a sidewalk. <br /> <br />Councilmember Elvig arrived at the meeting at 7:32 p.m. <br /> <br />Councilmember Dehen asked if this is considered a trail area or a sidewalk area. He noted that he <br />is not advocating cutting down trees, but noted that here needs to be some order and a policy for <br />this issue and it should be consistent and not changed in the middle. <br /> <br />City Council / June 23, 2009 <br />Page 5 of 11 <br />
