LRRATMO Meeting Minutes <br />July 7, 1989 <br />Page 5 <br />Pearson went on to state that because of the different types <br />of development areas, older and established verses new, there <br />will be different standards that apply depending on the <br />circumstances. This organization's goal should be for the <br />highest water quality possible. Standards should be consis- <br />tent throughout the watershed so the cities don't differ, <br />otherwise the goals won't be accomplished. <br />Schrantz reported that Andover is worried about there becom- <br />ing another level of government to have to go through. <br />Pearson confirmed that indeed this watershed is another level <br />of government. The emphasis is being placed on the quality <br />of water throughout the entire United States. This body's <br />function will be to enforce the rules. Pearson went on to <br />explain the legislature's compromise for farmers and how that <br />is handled. He urged that this board be consistent in the <br />setting of standards throughout the watershed and try to get <br />the communities to agree. <br />Upon discussion of enforcement, Pearson stated this board <br />will have to get involved. The cities can be the enforcement <br />agencies, but you and your consulting engineer should look at <br />the permits. It will be helpful to have the administration <br />in the hands of this board because of potential political <br />problems. <br />As to the issue of the consideration of variance approval, <br />Pearson replied that standard language, such as that relative <br />to planning and zoning, would be applicable. Some area of <br />flexibility should be built in. This organization or cities <br />could grant a variance. <br />Weaver summarized by stating that our proposed standards <br />should be submitted to our municipalities who then pass it on <br />to the Planning Commissions and City Councils for their <br />comments. They then come back to us for our consideration <br />and adoption. Mathisen queried this board's authority in <br />establishing these guidelines. Pearson responded that this <br />board will not have to have the concurrence of the other <br />cities. At this point Pearson indicated that the existing <br />Joint Powers Agreement between the member cities should be <br />updated. Schrantz felt that this board should be able to <br />adopt any regulations we see fit. Pearson confirmed that the <br />cities would be bound by this board's decision. Water <br />quality will be forced on you, and everyone might as well <br />pick up on it. <br />
