LRRWMO Meeting Minutes <br />September 17, 1992 <br />Page 7 <br />Ms. Brehm stated that if this project was done prior to the <br />new law, that wetland could have been filled. She indicated, <br />however, the City of Ramsey made an error in approving this <br />project after the 1991 Wetland Conservation Act was in place. <br />The act had been in effect for six months. Jankowski stated <br />the present position is the City of Ramsey will be to replace <br />that filled wetland to be in compliance with the act. <br />In answer to Weaver's query about whether this board was ever <br />made aware of this City of Ramsey proposal, Jankowski <br />recalled that the discharge issues were presented to the <br />board, but the wetland issues were not addressed; they should <br />have been. <br />Upon discussion of the size of this filled wetland, Ms. Brehm <br />reported that the SWCD also got a lot of calls about it. It <br />is Chris Lord's opinion that the soil samples taken indicate <br />the<site is bigger than the reported one -half acre. The SWCD <br />is reportedly willing to work with the City of Ramsey to get <br />that wetland properly replaced. <br />It was noted the Ramsey City Council will be meeting Tuesday, <br />September 22, 1992; and this issue will be on its agenda. <br />Ms. Brehm expected a lot of residents to be present at that <br />meeting. <br />Schrantz and Weaver concurred the LRRWMO As the LGU with <br />jurisdiction on this issue and must address this matter as a <br />board. It was further agreed that when problems arise which <br />require that this board be notified, the initial contact <br />shall be made to both the Chairman and the LRRTATMO member <br />representing the city in which the violation has occurred. <br />As for resolving this problem, Jankowski suggested the City <br />of Ramsey look for some replacement in the area. Ms. Brehm <br />indicated no cease and desist order has been issued for this <br />violation because she felt the builder had done what he was <br />supposed to do; he had gone to the city. She went on to <br />indicate that a permit must be obtained from the DNR Waters <br />Division for replacement of this protected wetland. She <br />urged that the City of Ramsey use the figures on the size of <br />the wetland as provided by the SWCD in order to keep everyone <br />happy. It was suggested that replacement be accomplished by <br />adding on to one of the protected wetlands at the site. Ms. <br />Brehm stated replacement of this wetland could be done <br />anywhere in the watershed the board wishes, but it is better <br />to have it on the site. <br />Ms. Brehm queried the board's policy on silt fencing within <br />the LRRWMO, noting there is no silt fence on this site. <br />
