-134- <br /> <br />Case #3: <br /> <br />Request for Final Plat Review of Rivenwick 3rd Addition; Case of Turtle <br />Moon, Inc. <br /> <br />Associate Planner Watd stated that Turtle Moon Inc. has applied for final plat approval of a <br />townhome development named Rivenwick 3r~ Addition. The property is generally located south <br />of Riverdale Drive and north of the existing Rivenwick urban residential development. The final <br />plat substantially conforms to the approved preliminary plat. City Engineer Steve Jankowski has <br />reviewed the Final Grading Plans, Construction Plans and Specifications. The City Staff Review <br />Letter dated March 7, 2003 outlines the required modifications and corrections that need to be <br />made to the plans. The City Council introduced a rezoning ordinance on January 14, 2003 to <br />rezone a portion of the property from B-1 Business to R-2 Medium Density Residential. Park <br />dedication will consist of a cash payment. However, the Park and Recreation Commission is <br />recommending that half of the park dedication fees go towards park improvements for Riverdale <br />Park, located adjacent_ to the plat, and existing parkland located along the Mississippi River. <br />Staff, the Park and Recreation Commission, and the developer may work on an amendment to <br />the Development Agreement to incorporate appropriate park improvements to the subject parks. <br />In the event all parities involved agree to park improvements, an amendment to the Development <br />Agreement will be brought back to the City Council. The final plat encumbers all common <br />opens spaces and drainage ponds with drainage and utility easements. Council's approval of the <br />preliminary plat was granted with certain contingencies that have been addressed as follows: 1) <br />An existing fence encroaches onto the developer's property. In order for Rivenwick 3rd Addition <br />to achieve clear title, the title company is requiring the fence be removed from Mr. Shulte's <br />property. Mr. Shulte, the developer, and Mr. Frankfurth, fence owner, agreed that Mr. Shulte will <br />have land surveyors mark the property line and Mr. Frankfurth will remove the encroaching <br />fence sometime this spring. 2) A part of the motion stated that no Certificate of Occupancies are <br />to be issued for any units until the intersection upgrade and traffic signals at Ramsey Blvd. and <br />Highway #10 are completed and accepted by the City and MnDOT. The developer is requesting <br />that building permits and certificate of occupancies be permitted for the first five-townhouse <br />structures (Lots I0, 9, 8, 7, Block 2 and Lot 5, Block I). until the intersection upgrade of <br />Highway #10 and Ramsey Blvd. is operational. Fire Chief Dean Kapler is supportive of the <br />developer's request from a public safety standpoint. Staff recommended final plat approved <br />contingent upon compliance with City Staff Review Letter dated March 7, 2003 and-the <br />Developer and-the City entering into a Development Agreement. It was noted that the <br />Development Agreement is drafted to restr/ct building permits and certificate of Occupancies to ' <br />the first five structures. Ms. Wald noted that #9 in the development agreement should include <br />the credit amount of $55,620. <br /> <br />Mayor Gamec inquired if the Council was Comfortable with allowing the first five: units to be <br />constructed prior.to the upgrade of Highway #10 and Ramsey Boulevard. <br /> <br />Dave Schulte, Turtle Moon, Inc., explained that the light installation is going to take awhile <br />because of MnDOT's requirements and they would like the opportunity to begin construction <br />this spring and build through the summer so that they have some units completed for the fall <br />Parade of Homes. <br /> <br />Consensus of the Council was to allow for five units to be constructed prior to the completion of <br />the upgrade of Highway #10 and Ramsey Boulevard. <br /> <br />City Council/March 11, 2003 <br /> Page 8 of 22 <br /> <br /> I <br /> I <br />I <br />I <br />I <br />I <br />I <br />I <br />i <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br /> <br />
