-142- <br /> <br />Mr. Caron replied that that is not the case at all. He explained that their plant is regulated.by <br />pollution control and the EPA has looked into the safety of asphalt plants. <br /> <br />Councilmember Pearson inquired if Mr. Caron has received complaints at any of their other <br />plants. <br /> <br />Mr. Caron replied that they did have similar complaints at their Scandia plant. They have <br />introduced the additive and increased the height of the smokestack at that plant and since that <br />time they have not received any complaints. <br />Councilmember Kurak stated that the issue was brought about last year because she thought-the <br />permit was up for renewal or was the issue brought forward because of the complaints staff · <br />received. <br /> <br />Community Development Director Frolik replied that the issue was brought forward because of <br />the complaints, the permit's in effect until 2005. <br /> <br />Councilmember Kurak inquired if Mr. Hamilton complains that the smells are worse at a certain <br />time of day. <br /> <br />Community' DeVelopment Director Frolik explained that it seems that the smells are more <br />impacted by weather conditions. <br /> <br />Councilmember Strommen stated that it is important that monitoring is done in some sort of <br />systematic way. If they are going to receive reports on a quarterly basis, she would like to see a <br />reference to the amount of additive that has been used. She inquired if staff had a <br />recommendation on how long the probation period should be. <br /> <br />Community Development Director Frolik explained that on a fiscal basis, the first report would <br />be due to the City Council the first meeting of July'. <br /> <br />Motion by Councilmember Zimmerman,-seconded by Councilmember Strommen, .to direct <br />Commercial Asphalt to step up enforcement of additive standards and/or increase the,. height of <br />the smokestacks and direct City staff to make quarterly status reports to the City Council <br />regarding plant operations until the end of the year. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Zimmerman, Strommen, <br />Cook, Elvig, Kurak, and Pearson. Voting No: None. <br /> <br />Case #10: Addendum to Ramsey Town Center Retail Market Analys~s <br /> <br />City Administrator Norman stated that on January 13, 2003, the EDA made a recommendation to <br />the City Council to move forward, with a market analysis for the retail node of Highway #47 and <br />167th Avenue, contingent upon staff working with McComb Group to negotiate a more cost <br />effective proposal. The City Council reviewed the recommendation during their January 28, <br />2003 meeting. The City Council directed staff to obtain additional proposals.
