Jankowski did not think it was, <br />but admitted that possibility was not discussed. <br />Weaver queried whether time is a major factor in this <br />situation. He went on to state that while he empathized with <br />the developer's and Jankowski's position, he cautioned that <br />in the future should it come to light that there is a <br />negative impact to the Rum River because of the drainage from <br />this development, there could be serious litigation issues <br />with which the LRRWMO must contend. There are proposed catch <br />basins that will flow into the Rum River, if they are <br />retained. <br />Jankowski confirmed if they retain. this plan as shown there <br />will be discharge to the Rum River, not much, but some. He <br />suggested more of this drainage be directed to the northwest. <br />If that is done, there will not be one drop of water from <br />this plat going directly to the river without sedimentation; <br />only in a case of emergency, which is a fairly remote <br />possibility. <br />Schrantz stated the developer still has to provide for an <br />explanation of his ponding and detention basins. Jankowski <br />was of the opinion that that has been done. Schrantz added <br />that application for a PCA permit would have to address <br />grading and require better management practices. This is a <br />new requirement as of the first of the year. Schrantz <br />indicated, however, the turn around process with the PCA is <br />48 hours. <br />Weaver noted that this is a big project. The developer is <br />proposing to reduce the flow into the Rum River, which is a <br />positive move. However, Weaver noted, and Jankowski <br />confirmed, that water from the other side of 149th will still <br />go into the Rum River, a gravity flow. Jankowski stated <br />there will be sedimentation ponds for that drainage on one <br />side of the street before it hits the river. The other half <br />of the street will still flow directly to the river, unless <br />they take it and put basins in that side of the street also. <br />Schrantz indicated he and Weaver are not in a position to <br />thoroughly study this proposed plat in detail; that is what <br />the Consulting Engineer is for. A suggested alternative was <br />that Jankowski write a letter to the LRRWMO indicating it is <br />Ramsey's position that the proposed plan follows LRRWMO <br />procedure and does not have to go to the Consulting Engineer. <br />Weaver expressed a concern with that action. He felt this <br />board has an obligation as a governmental entity to do what <br />is correct. Weaver stated he would much prefer if the LRRWMO <br />
