As for most of this document, <br />Ferguson admitted to not being experienced enough to comment <br />on it in great detail. <br />Jankowski recalled that Attorney Curtis Pearson's concern was <br />that the LRRWMO Joint Powers Agreement contain elements in <br />order that this organization be in conformance with the law. <br />He suggested someone check with Pearson on which elements of <br />concern raised could be eliminated or modified as suggested. <br />Weaver concurred. <br />Ferguson reported that Mr. Ottensman is especially concerned <br />about the power being taken away from the cities and is not <br />willing to give up those rights without a fight. Schultz <br />concurred with that assessment. He went on to add that he <br />felt this board will have to take a firm stand on the amount <br />of power it allows other agencies, such as BWSR, with regard <br />to our cities. <br />Motion was made by Jankowski, seconded by Perry to AUTHORIZE <br />LRRWMO ATTORNEY CURTIS PEARSON TO REVIEW THE CONCERNS RAISED <br />IN BILL OTTENSMAN'S AUGUST 5, 1993, LETTER AND PREPARE A <br />RESPONSE CONCERNING WHICH ISSUES ARE DISCRETIONARY TO THIS <br />DOCUMENT AND WHICH ARE ABSOLUTELY MANDATED BY LAW. FURTHER, <br />PEARSON IS DIRECTED TO PREPARE AN AMENDED DOCUMENT INCORPORA- <br />TING ITEMS OF MR. OTTENSMAN'S LETTER. (See addition to the <br />motion further along in discussion.) <br />The board acknowledged that the updated Joint Powers Agree- <br />ment should have been ratified by August 1, 1993; and encour- <br />aged each member to proceed with all haste in approaching its <br />city councils for .comment/approval of the resolution pertain- <br />ing to this document. <br />Weaver reiterated he is delighted with Mr. Ottensman's <br />comments and would like to see Pearson put them in the Joint <br />Powers Agreement to the extent he is comfortable in doing so. <br />He asked that a fully altered document be returned to the <br />LRRWMO showing the changes and deletions in the accepted <br />manner of placing dash lines. over the deleted or altered <br />portions of the document. <br />Haas stated he has taken the changes back to the Andover City <br />Council twice and has twice received resolution approval. <br />Jankowski indicated only Ramsey's Finance Committee have thus <br />far been scheduled to review the draft agreement. However, <br />he was told to wait until a revised document is available. <br />Weaver stated-the Anoka City Council has indicated until the <br />LRRWMO has ratified the document it does not want to be <br />involved with it again.
