LRRWMO Meeting Minutes <br />August 19, 1993 <br />Page 10 <br />Beduhn's memorandum indicated he had written to Anoka County <br />expressing the board's concerns; however, no such copy of <br />that letter was attached to his memorandum for the board's <br />information. <br />Jankowski's position was Anoka County either complies with <br />the original mitigation plan or must resubmit anew plan. <br />Ferguson concurred; without an updated plan the LRRWMO can <br />only assume the original, approved plan will be maintained. <br />Haas stated, technically, Anoka County, is violating its <br />permit right now. <br />Perry noted whereby Beduhn's concerns addressed drainage <br />problems, not mitigation. Schultz reported talking to Anoka <br />County's Design Engineer, Doug Fisher, who indicated the <br />county would take care of that problem. <br />Perry and Haas suggested perhaps this is an instance where a <br />cease and desist order should be served on the county. <br />Motion was made by Perry to ISSUE A CEASE AND DESIST ORDER ON <br />ANORA COUNTY, LRRWMO PROJECT #93-3. JUSTIFICATION FOR SAID <br />ACTION IS THAT THEY HAVE NOT MET THE ORIGINAL PLANS SUBMITTED <br />AND APPROVED IN THE ORIGINAL PERMIT. ANOKA COUNTY HAS NOT <br />SUBMITTED A NEW PLAN FOR DRAINAGE AND MITIGATION. (Motion <br />withdrawn further along in discussion.) <br />Considerable discussion ensued. The board finally agreed <br />that Beduhn should go out and inspect the project, itemize <br />the problems and, if necessary, issue a cease and desist <br />order. <br />Perry agreed to withdraw his motion. <br />Motion was made by Perry, seconded by Weaver, that IN LIGHT <br />OF THE FACT THAT THE LRRWMO ENGINEER HAS NOT HAD A RESPONSE <br />TO THE BOARD'S REQUEST FOR INFORMATION FROM THE COUNTY, THE <br />LRRWMO AUTHORIZES ITS CONSULTING ENGINEER TO REINSPECT THE <br />SITE AND MAKE RECOMMENDATION TO US ON WHETHER A CEASE AND <br />DESIST ORDER SHOULD BE PUT IN PLACE. <br />Jankowski indicated Beduhn should provide a report at-the <br />September regular meeting, charging off these expenditures to <br />the Anoka County permit. <br />VOTE: 4 ayes - 0 nayes. Motion carried. <br />
