LRRWMO Meeting Minutes August 19, 1993 Page 10 Beduhn's memorandum indicated he had written to Anoka County expressing the board's concerns; however, no such copy of that letter was attached to his memorandum for the board's information. Jankowski's position was Anoka County either complies with the original mitigation plan or must resubmit anew plan. Ferguson concurred; without an updated plan the LRRWMO can only assume the original, approved plan will be maintained. Haas stated, technically, Anoka County, is violating its permit right now. Perry noted whereby Beduhn's concerns addressed drainage problems, not mitigation. Schultz reported talking to Anoka County's Design Engineer, Doug Fisher, who indicated the county would take care of that problem. Perry and Haas suggested perhaps this is an instance where a cease and desist order should be served on the county. Motion was made by Perry to ISSUE A CEASE AND DESIST ORDER ON ANORA COUNTY, LRRWMO PROJECT #93-3. JUSTIFICATION FOR SAID ACTION IS THAT THEY HAVE NOT MET THE ORIGINAL PLANS SUBMITTED AND APPROVED IN THE ORIGINAL PERMIT. ANOKA COUNTY HAS NOT SUBMITTED A NEW PLAN FOR DRAINAGE AND MITIGATION. (Motion withdrawn further along in discussion.) Considerable discussion ensued. The board finally agreed that Beduhn should go out and inspect the project, itemize the problems and, if necessary, issue a cease and desist order. Perry agreed to withdraw his motion. Motion was made by Perry, seconded by Weaver, that IN LIGHT OF THE FACT THAT THE LRRWMO ENGINEER HAS NOT HAD A RESPONSE TO THE BOARD'S REQUEST FOR INFORMATION FROM THE COUNTY, THE LRRWMO AUTHORIZES ITS CONSULTING ENGINEER TO REINSPECT THE SITE AND MAKE RECOMMENDATION TO US ON WHETHER A CEASE AND DESIST ORDER SHOULD BE PUT IN PLACE. Jankowski indicated Beduhn should provide a report at-the September regular meeting, charging off these expenditures to the Anoka County permit. VOTE: 4 ayes - 0 nayes. Motion carried.
