LRRWMO Meeting Minutes <br />July 15, 1993 <br />Page 15 <br />Ferguson felt the board's position could be to accept such a <br />mitigation proposal in that the pond was created during the <br />interim rule period. <br />Schultz queried whether the pond has been recorded as a legal <br />wetland. <br />Beduhn recommended he discuss this issue further with BWSR. <br />He noted that during the interim rules, .the WMO has final say <br />on wetland issues. However, he did not know if the Corps of <br />Engineers would accept it. <br />Jankowski stated the concept of replacement is acceptable to <br />him as long as the proper information provided satisfies our <br />technical engineer: <br />Beduhn noted that the applicant will need to obtain a permit <br />from the Army Corps of Engineers also. <br />Motion was made by Weave, seconded by Ferguson, to APPROVE <br />APPLICATION #93-8, WOOD POND HILLS THIRD AND FOURTH ADDITION, <br />CONTINGENT ON THE SATISFACTION OF ELEVATION CONCERNS <br />EXPRESSED BY TBE LRRWMO CONSULTING ENGINEER. <br />4 ayes - 0 nayes. Motion carried. <br />Grading and Wetland Plan for County Road 116 Reconstruction <br />Beduhn discussed with the board his April 12, 1993, update of <br />the Anoka County Road 116 Reconstruction project. He <br />indicated a grading, drainage and wetland plan for <br />reconstruction of County Road 116 was received by Barr <br />Engineering April 21, 1993. However, on June 25, 1993, he <br />received a telephone call from Doug Fischer, Anoka County <br />Highway Department, informing him that once work began, the <br />county found some of the upland area proposed for conversion <br />to wetland as part of the mitigation plan was already <br />wetland. Therefore, the county did not have enough upland <br />area on the project to mitigate, as specified in the mitiga- <br />tion plan. In response to Mr. Fisher's inquiry as to the <br />possibility of mitigating on a future highway project, Mr. <br />Beduhn reportedly instructed Mr. Fisher to send a letter to <br />the LRRWMO board describing the situation and making such a <br />request. <br />Schultz indicated he, as the Public Works Director of the <br />city in which the project is taking place, does not know <br />anything about this new development on the County Road 116 <br />project. He questioned whether the proposed action would be <br />acceptable to the City of Anoka in that the county will be <br />
