LRRWMO Meetinq Minutes <br />June 23, 1993 <br />Page 8 <br />Haas stated he is comfortable with what is being proposed. <br />However, he did indicate Mr. Pederson will have to get <br />permits from the county for any ditch cleaning. <br />Jankowski queried whether the wetlands have been delineated <br />on the applicant's property; other restoration plans have <br />required delineation. He felt the board should require the <br />same level of information on this mitigation plan as on <br />others. Haas concurred. Mr. Pederson stated Anoka County <br />Soil and Water Conservation District's (SWCD) Chris Lord <br />showed the. types of lands in his letter on the cease and <br />desist order. He was reportedly told by Mr. Lord to take <br />identifiable pictures of the area so that improvements could <br />be identified upon inspection. Jankowski noted that the <br />question of inspection is still uncertain; who should be <br />doing it. <br />Jankowski stated he would like to see the identified areas <br />being proposed for mitigation on this plan. Just showing the <br />upland is not sufficient. Mr. Pederson again referred to the <br />map provided, indicating there will be a 90 x 12 feet area <br />being taken out. There is a 14 x 90 foot area identified on <br />a letter from Mr. Lord. <br />Jankowski stated he feels Mr. Pederson probably has all the' <br />necessary information; however, it should be condensed on one <br />document/map. Mr. Pederson agreed he would eliminate one <br />drawing. <br />In answer to Weaver's query as to whether Mr. Pederson has <br />complied with the restoration order, Jankowski noted Beduhn's <br />comments indicating Mr. Pederson does not wish to fully <br />comply; he is proposing an alternative. Mr. Pederson <br />indicated he would comply in some respects, but he wants to <br />leave the road there in order to be able to get back to the <br />high ground. Without it, he must use boots. Mr. Pederson <br />stated unfortunately the road is already in because he did <br />not know he could not disturb that area. He indicated he is <br />hoping to be able to leave those two areas alone, doing a <br />trade-off by removing the high ground in front of the pond to <br />offset 1:1 with what he wants to leave. The applicant <br />indicated in proving he has done the proposed mitigation he <br />would put in stakes on the edge of the pond and move it back, <br />later removing the identifying markings. <br />Haas noted he has 30 days to comply with the restoration <br />order. Weaver stated the restoration can be delayed to <br />September 1, 1993; however, Mr. Pederson's 30 days have <br />already expired. <br />
