LRRWMO Meeting Minutes <br />June 23, 1993 <br />Page 9 <br />Ferguson asked how high the area is around the edge of the <br />pond. Mr. Pederson's response was 6-12 inches directly <br />around the wetlands. Upon further discussion Mr. Pederson <br />stated he wants to be able to stockpile black dirt in the <br />area. Ferguson cautioned that the applicant is not creating <br />an additional wetland by doing so. <br />Weaver stated we have a case here where actions of previous <br />years have been taken without concern expended by anyone. <br />This is a continuous activity. He felt what is proposed is <br />probably as sensible mitigation as what could be done under <br />the circumstances. Weaver indicated he was comfortable with <br />it. <br />Jankowski concurred there was no intent here to break the <br />law. However, his concern is that the person inspecting the <br />mitigation will have sufficient information to certify Mr. <br />pederson has complied with the restoration order and mitiga- <br />tion plan. Haas stated that Beduhn was at the site initially <br />along with the DNR and SWCD and did inspect it. Weaver and <br />Haas concurred it should be the LRRWMO Consulting Engineer <br />who should inspect it. That action would place this organi- <br />zation where it belongs, as the Local Governmental Unit <br />(LGU). <br />Jankowski stated he could support this proposed mitigation <br />plan based on Beduhn's recommendation, provided he will come <br />back and certify the restoration/mitigation plan has been <br />complied with. <br />Motion was made by Weaver, seconded by Ferguson, to APPROVE <br />THE PROPOSED MITIGATION PLAN AS SUBMITTED BY MR. RANDY <br />PEDERSON AND TO AUTHORIZE THE LRRWMO CONSULTING ENGINEER TO <br />PROVIDE THE NECESSARY ENGINEERING SERVICES TO INSPECT THE <br />SITE AND CERTIFY THE COMPLETION OF THE RESTORATION; CONFIRM- <br />ING THAT THE MITIGATION IS CONSISTENT WITH THE MITIGATION <br />PROPOSED AND RESTORATION PLAN AND TO FILE A CERTIFICATION OF <br />THE MITIGATION PROCESS. MR. PEDERSON SHALL PROVIDE "AS <br />BUILTS" AS RECOMMENDED BY THE LRRWMO CONSULTING ENGINEER. <br />3 ayes - 0 nayes. Motion carried. <br />The board indicated the LRRWMO Engineer will have to look at <br />Mr. Pederson's property identified as being in violation <br />before the applicant takes further action. <br />Haas indicated he would send copies of these maps to the <br />LRRWMO Administrative Secretary for proper distribution. <br />Jankowski directed that Ms. Brehm and the SWCD be sent a copy <br />of the approved LRRWMO permit, indicating this board has <br />
