<br />LRRWMO Meeting Minutes <br />April 21, 1994 <br />Page 7 <br />First Quarter 1994 Reports -Andover. Anoka. Coon Rapids. Ramsey <br />Haas submitted and reviewed Andover's First Quarter 1994 Report. He explained the <br />developer of Kobs' First Addition is in violation of his grading, drainage and erosion control <br />plan so he will contact him. <br />It was noted that the Meadows of Round Lake and Timber Meadows projects are 90% <br />complete and the Round Lake BoulevardBunker Lake Boulevard project has been under <br />construction for approximately nine months. Haas stated the City will monitor erosion <br />control with these projects. <br />First Quarter 1994 Reports from Anoka, Coon Rapids and Ramsey not available; placed on <br />May agenda. <br />CONSIDERATION OF JOINT POWERS AGREEMENT (JPAI <br />Jankowski reviewed the letters received from Thomas Gedde, Attorney for the City of <br />Anoka, and Curtis Pearson, Attorney for the LRRWMO, regarding changes to the JPA. <br />With regard to the workman's comp. reference, Ferguson reported the Coon Rapids City <br />Attorney felt it does not mean a consultant would be considered an employee, and unless <br />the consultant met the definition of "employee" the LRRWMO would not be liable for <br />workman's comp. <br />Jankowski reported the Attorney for Ramsey felt the LRRWMO would be liable but agreed <br />this is somewhat of a "grey" area and may depend on the percentage of time the consultant <br />spends working for the LRRWMO. <br />Consensus was reached to leave the reference to workman's comp. coverage as is. <br />Following a detailed review, consensus was reached to make the following <br />changes/corrections: <br />Page 2, #1 of Preface: "Protect and preserve natural surface and groundwater <br />storage and retention systems;' <br />Page 9, VI, Sub. 2: "It may employ such persons or contract with consultants as it <br />deems necessary to accomplish its duties and powers, and any such persons or <br />consultants shall be considered Commission staff." <br />Page 10, VI, Sub. 8: "It may, if necessary to implement the plan, order any member <br />governmental unit ..:' <br />Page 11, VI, Sub. 11: "It shall contract for or ... <br />
