<br />LRRWMO Meeting Minutes <br />January 19, 1995 <br />Page 7 <br />The LRRWMO requested a revised contract indicating the clarification to travel time and <br />invoicing. Consensus was reached to authorize SEH to proceed with data collection and <br />requesting input from regulating agencies. The contract will be considered at the February <br />16, 1995 meeting. <br />CONSIDERATION OF COMMUNICATIONS <br />Review Correspondence in Chair's Folder <br />Jankowski reviewed the correspondence and notices contained in the Chair's Folder, noting <br />they do not require action. <br />Informational; no action required. <br />Cease & Desist Order -Steven Fries Letter from Beduhn -Andover <br />Jankowski reviewed the January 5, 1995 memorandum from Bob Beduhn indicating <br />outstanding issues with the Steven Fries Cease & Desist Order and his suggested solution <br />that Fries must substantially comply with the restoration order. <br />Beduhn has indicated the best solution would be to remove the fill placed to create the new <br />driveway and use the fill to improve the driveway on the southeast corner of the propeirty. <br />As long as Fries places fill on the old driveway to raise its elevation without any additional <br />fill of the wetland. If some additional filling is necessary, Fries could request a one time <br />exemption for the fill of 400 square feet without mitigation. Any additional fill would have <br />to pass the sequencing test and amitigation/replacement plan would have to be prepared <br />for the total area filled. <br />Haas reported that Fries has not followed the correct process so a memorandum has been <br />sent to him advising him that he has several weeks to provide the required information or <br />the DNR will resolve the matter in court. <br />Wetland Banking Discussion -Beduhn Memo <br />Jankowski asked if the LRRWMO would be interested in purchasing banked wetland. He <br />noted that while this is an interesting concept, it would be difficult to bank what is beyond <br />their physical control. <br />The members reviewed the January 11, 1995 memorandum from Bob Beduhn indicating <br />Fries proposed to purchase wetland azeas the LRRWMO allowed Johanson to bank under <br />the interim program of the WCA of 1991. The DNR has indicated if Johanson is interested <br />in converting the banked wetland into the permanent program, he should contact the <br />LRRWMO to begin the conversion process. The LRRWMO could require an escrow <br />deposit to defray the administrative expenses of the conversion process. <br />
