He advised that Obermeyer (Barr Engineering) had indicated a skimmer will be needed since the inverted pipe would still allow debris to pass should the pond overIlow. A short discussion was held regarding the use of an inverted pipe versus a skimmer. Cronin stated they will construct the skimmer if the LRRWMO so requests. He advised all other comments by Obermeyer have been included in the revised plans. Moved by Weaver, seconded by Ottensmann, to approve LRRWMO Permit #95-14 for the construction of a SuperAmerica Station in the northwest quadrant of the intersection of TH47 and CR116 in Ramsey subject to the ten conditions as detailed in Bob Obermeyer's memorandum dated September 15, 1995. Vote: 4 ayes, 0 nays. Motion carried. LRRWMO Permit #95-15 -Warta Residence -Andover Jankowski noted Permit 95-15 is to modify 5,440 square feet of Type II wetland area to Type IV wetland. This is a private project to be completed by the property owners, Chris and Tom Warta. The LRRWMO reviewed Obermeyer's memorandum and recommendation for approval subject to six conditions. Ottensmann noted the number of outstanding issues and need for other agency permits. He questioned whether this application was sufficiently complete for consideration. Haas explained a DNR permit will not be required since it is not a DNR protected wetland. He stated he understood the applicant's desire to dredge out the wetland to create open water, but was unaware they intended to place a sand layer along the bottom of the excavated azea. It was noted that Obermeyer recommends this sand layer not be allowed without further mitigation requirements. Ottensmann questioned whether their intention was to create a recreation azea for swimming. Haas stated he was unsure. Weaver noted if the sand layer is to be placed, 2:1 mitigation would be required. Ottensmann concurred and commented it will be difficult to determine how mitigation would be applied. Jankowski questioned the need for mitigation if the sand layer only brings the elevation back to pre-dredging conditions.
