LRRWMO Meeting Minutes <br />July 20, 1995 <br />Page 6 <br />indicates the LRRWMO has the authority to waive the June 30th deadline and they would <br />support doing so based on the fact that he may not have been adequately notified of <br />deadlines, that banking the overage was openly discussed prior to the creation of the <br />wetland, and that the creation was successful and new wetland now exists on the property. <br />Johanson noted the July 17, 1995 letter from Chris Lord details this information and <br />indicates six steps to be taken to proceed with banking. Johanson stated he has already <br />addressed several of the tasks outlined in the LRRWMO letter of February 9, 1995 and does <br />not believe he needs to comply with the one-year monitoring period since he was under the <br />interim process. <br />Fries stated it is his intention to buy 12,000 square feet of banked wetland from Johanson, <br />narrow the driveway, eliminate the old access area, and not dig the pond as currently <br />indicated on the plan. He stated this will comply with the 2/1 mitigation being required. <br />Weaver asked if Andover is comfortable with Fries' plans. Haas stated the priority is <br />providing the 2/1 mitigation. Weaver and Schultz supported allowing Fries to simply identify <br />on the plan that the pond will be "eliminated" rather than requiring Fries to redraw the plan. <br />Haas concurred. <br />Johanson advised that after selling Fries 12,000 sq. ft. he will have 1,930 sq. ft. remaining <br />which is still eligible for banking. He explained Fries will be doing some excavation work <br />as partial payment for the property (rather than making full cash payment) and they have <br />entered into a written agreement detailing this transaction. He estimated it will take 60 days <br />to complete this process and asked the LRRWMO if they would like to bank the 12,000 sq. <br />ft. needed by Fries locally and then send the remaining 1,930 sq. ft. to the BWSR bank. <br />Motion by Weaver, seconded by Ferguson, to rescind the previously approved motion made <br />on June 15, 1995 to accept a compromise position of 1.45/1 mitigation for Steven Fries, <br />LRRWMO Permit #94-16. Vote: 3 ayes, 1 present (Haas). Motion carried. <br />Motion by Weaver, seconded by Ferguson, in light of WCA permanent rule mitigation <br />requirements, to require a 2/1 mitigation for Steven Fries, LRRWMO Permit #94-16, with <br />the understanding he will be mitigating 12,000 sq. ft. off site. Vote: 4 ayes, 0 nays. Motion <br />carried. <br />Motion by Weaver, seconded by Ferguson, in light of the July 17, 1995 letter from Chris <br />Lord of the Anoka Conservation District, to approve the following actions: <br />1. Waive the June 30, 1995 banking deadline for Russell Johanson based on the <br />rationale that banking was openly discussed prior to creation of the wetland, <br />creation was successful, and new wetland now exists <br />2. Approving the banling of 13,930 sq. ft. as proposed by Russell Johanson and <br />certified by Chris Lord, Anoka Conservation District <br />i <br />
