LRRWMO Meeting Minutes <br />June 15, 1995 <br />Page 7 <br />Ramsey reports not available; placed on July 20, 1995 agenda. <br />First Quarter 1995 Reports -Coon Rapids & Ramsey <br />Ferguson submitted the First Quarter 1995 Report noting no construction project activity <br />within the boundaries of the LRRWMO. <br />Ramsey reports not available; placed on July 20, 1995 agenda. <br />OLD BUSINESS <br />Joint Powers Agreement -Update Re: Ramsey <br />Jankowski advised he supports the compromise position proposed by Curt Pearson <br />(LRRWMO Attorney) in the second pazagraph of his conclusion: "Leave in the provisions <br />of Subd. 6 and make the proposed changes in Article VII, Subcl. 5 that you have shown on your <br />draft, with the change that you make reference that the apportionment of costs of any capital <br />improvements to the respective members would be based on a negotiated agreement to be arrived <br />at by the members who have lands in the subdistrict and to add a sentence that said that if there <br />cannot be a negotiated agreement, the parties would agree to submit the matter to arbitration in <br />accordance with Article VII, Subcb 6." Jankowski stated he sent a copy of Peazson's letter to <br />the Ramsey Attorney and Mayor. <br />Ferguson questioned whether the arbitration in accordance with Article VII, Subd. 6 would <br />be binding arbitration. <br />Schultz suggested that further action by the other members be delayed until the Ramsey <br />Council receives the recommendation of their attorney and takes final action. Schultz <br />pointed out that Anoka already has agreements with Coon Rapids and Andover regarding <br />drainage which spells out what would happen in a disaster situation, etc. <br />Jankowski stated he believes the driving concern is with the dam and the potential for a <br />major project in the future. <br />Schultz stated if this is the case, he would suggested it be addressed separately in an <br />addendum and the JPA not be changed. <br />Ferguson agreed and reported on a Six Cities project where a disagreement on cost sharing <br />has arisen between two member cities. <br />Schultz noted the LRRWMO does not have an agreement with the Upper Rum River <br />WMO regarding water flow from upstream which can have an effect on down-stream <br />communities. <br />
