LRRWMO Meeting Minutes <br />May 15, 1997 <br />Page 4 <br />DISCUSS PLAN UPDATE -COMMENTS TO AGENCIES <br />Jankowski reviewed the letter dated May 14, 1997 from Chazles LeFevere, legal counsel, indicating <br />that it will not be necessary to amend the Joint Powers Agreement in order to satisfy BWSR. <br />Consensus was reached in support of this letter. The Administrative Secretary was directed <br />to forward a copy to Lobermeier and to ask him to immediately forward agency comments to <br />LRRWMO members and schedule to attend the June 19, 1997 meeting to discuss these <br />comments. Consensus was also reached to advertise the public hearing notice on cable <br />television. <br />Boundary Alignment <br />Ferguson noted the boundary alignment issue and asked if it should be addressed. He noted a project <br />along Idighway 10 where the drainage is within Coon Creek jurisdiction but the boundary line is split <br />between the Coon Creek WMO and LRRWMO. <br /> <br />Schultz suggested the jurisdiction where the majority is directed assume authority. • <br />Ferguson raised the issue of assessment for one district or the other. <br />Jankowski reviewed the options available; requiring a permit if within the LRRWMO boundary, or <br />to realign the boundary. He noted there should be no "gap" in coverage which is what BWSR will <br />be concerned about. Ferguson reviewed his reseazch of the boundary and jurisdiction issues and <br />agreed there appears to be no missing azea or overlap. <br />Jankowski agreed that this would be the appropriate time to amend the boundary with Coon Creek, <br />if desired. <br />Haas stated there is also a boundary in the north centraUnorth east azea of Andover which needs to <br />be amended. Schultz noted there may be a requirement for a legal description as part of this process. <br />Haas and Ferguson agreed to work together to raise this issue and attempt to revise both at <br />the same time, prior to finalizing the Plan update maps. <br />It was noted the public hearing to consider the LRRWMO Second Generation Draft Water <br />Management Plan is scheduled for Wednesday, May 21, 1997, at 7:00 p.m., at the Andover City Hall. <br />-- Haas stated he will ask cable television to film the meeting for rebroadcast: Weaver indicated he will • <br />be unable to attend the public hearing. Schultz advised he is also unable to attend so Russ Zastrow <br />will attend to represent the City of Anoka. <br />
