w LRRWMO Meeting Minutes <br />April 17, 1997 <br />Page 5 <br />Comments on Plan Update <br />Lobermeier advised comments have been received from all seven agencies and the LRRWMO's <br />response is due back to agencies by April 25, 1997. He reviewed the comments made by each agency <br />and stated some are more of an informational nature. <br />Haas suggested the BWSR comments pertaining to the Joint Powers Agreement (7PA) be <br />incorporated during the next JPA update. Lobermeier stated while he agrees with Haas that BWSR <br />should have made these comments when the JPA was originally submitted, BWSR may not approve <br />the Plan update if their comments are not incorporated at this time. Lobermeier stated these <br />amendments are minor but recommended the LRRWMO obtain legal counsel. <br />The LRRWMO directed these BWSR comments on the LRRWMO JPA to be submitted to <br />Curt Pearson (legal counsel) and ask him to draft an addendum for consideration at the neat <br />meeting. <br />Lobermeier noted the Minnesota Department of Agriculture and Anoka County Community Health <br />& Environmental Services Department had no comments. <br />With regard to the DNR letter, Lobermeier noted the need to address several of their comments. He <br />pointed out their suggestion to include riverfront projects in the Plan and suggested that Statute does <br />not require this inclusion. He noted the DNR request regarding best management practices and role <br />with on-site septic (city issue/not LRRWMO jurisdiction). On the public ditch policy, several <br />agencies raised questions whether the LRRWMO Plan meets the letter of the law. <br />Lobenneier noted the comments on enforcement tone and meeting standards in implementation and <br />suggested the JPA is the enforcement instrument. He suggested a similar response to that used by <br />Six Cities with regard to this particular comment. <br />Lobermeier noted the ACD comments and suggested if found to be valid, they be incorporated. <br />Lobetmeier explained the format for his response to these comments which will either thank them for <br />their suggestion or indicate the comment will be further addressed in the Plan update. He stated his <br />goal is to prepare the response and mail it by the end of next week. He asked to what degree the <br />LRRWMO would like to review those comments. <br />Ferguson suggested the format used successfully by Six Cities be followed. The LRRWMO reviewed <br />• the format and agreed SEH should use the same format for the LRRWMO response. <br />Jankowski stated he would like the opportunity to review the response prior to mailing to agencies. <br />Lobermeier stated the LRRWMO could request an extension. Jankowski suggested the response be <br />placed on the May 15, 1997, meeting agenda and that the public hearing be scheduled at that time. <br />Lobermeier stated he will contact BWSR to make this extension request. <br />
