• LRRWMO Meeting Minutes <br />December 18, 1997 <br />Page 7 <br />Jankowski noted that wetland replacement projects have been looked at by the engineer to verify that <br />a wetland has been established. <br />Haas stated this is correct and noted the reference in Obermeyer's memorandum that a field inspection <br />with the TEP, yearly reporting, etc. are applicable. <br />7effPerry, Natural Resource Specialist with Anoka County Parks and Recreation, stated he met with <br />representatives of BWSR, the Army Corp of Engineers, and DNR to assure all "bases" were covered. <br />According to the WCA, they are required to have the Conservation District come out one year after <br />project completion for inspection and continue inspections for five years. He explained that this <br />process is required to be followed to get the banking Credits. <br />Haas asked if the ACD is responsible to keep "tabs" on when inspections aze_ needed. Perry stated _ <br />this is correct. <br />Schultz inquired regarding the process should an inspection discover that the wetland vegetation has <br />• failed and is no longer established. He also asked who covers the cost of inspection. <br />Perry stated they would have to reestablish the wetland vegetation. Haas stated the ACD usually <br />picks up their own costs. <br />Jankowski noted that it could be 2003 before the wetland is released and, until that time, the <br />LRRWMO would hold the permit fee in escrow.-"He noted-that the LRRWMO~could so not re ease -° °- ~- <br />theirbanking credits until it is certain the wetland has been established. <br />Schultz stated the concern is that the wetland azea would be lost and he would think the LRRWMO <br />could, if needed, establish the wetland and then assess the cost back to the property owner (unless <br />it is a public entity). <br />Haas asked if the LRRWMO has the authority to assess. Ferguson stated he does not believe they <br />do. <br />Ferguson stated if a failed wetland needs to be restored by the LRRWMO, the several hundred dollazs <br />remaining of the permit fee would not be sufficient. Therefore, he does not have a problem with <br />releasing the fund after the yeazly inspections. <br />Haas suggested Obermeyer be asked whether it is a requirement to have an inspection every year for <br />all five years. <br />
