April 28, 1988 <br />Page Five <br />"Except as provided in this subdivision, a <br />metropolitan county may acquire a site and buffer <br />area for a solid waste disposal facility anywhere <br />within the county without complying with local <br />ordinances if the action is approved by the <br />council as being taken pursuant to the policy plan <br />and the development schedule adopted under <br />Section 473.149, subd. 2(e) and the provisions of <br />Section 473.833, and the county may establish an <br />operator contract for the establishment or <br />operation of a disposal facility at the site <br />without complying with local ordinances, if the <br />council certifies need under Section 473.823, <br />subd. 6. No local government unit shall <br />prevent the establishment or operation of any <br />solid waste facility in accordance with the <br />council's decision under section 473.823, <br />subdivision 5, except that, with the approval of <br />the council, the local government unit may impose <br />reasonable conditions respecting the construction, <br />inspection, monitoring and maintenance of a <br />facility." <br />While the Draft EID does mention the fact that Site P is <br />currently in Anoka County's landfill inventory, see pages 2-14 to <br />2-20, it contains absolutely no mention of the above-noted <br />statutes which preclude the city's ability to expand the airport <br />if that expansion jeopardizes the use of Site P as a future <br />landfill site. Furthermore, in view of these statutes, the <br />statement "any expansion or new landfill would be prohibited by <br />the airport zoning ordinance" at page 2-20 of the document is <br />inaccurate. <br />5. The Draft EID should be revised to reflect the recent <br />rendum invalidating Ramsey's airport safety zoning ordinance. <br />The Draft EID reports at page 2-19, that the airport safety <br />zoning ordinance adopted by the City of Ramsey in 1987 was <br />subject to a referendum. On April 19, after the Draft EID was <br />prepared, the citizens of Ramsey, in a referendum, repealed this <br />ordinance. The document should be supplemented to discuss the <br />impact of the repeal of this ordinance on the project. <br />
