<br />CASE # '1.01 <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO OPERATE A <br />DA YCARE IN THE B-1 GENERAL BUSINESS DISTRICT <br />Case of El Gato con Botas Learning Center, Doris Griep <br />By: Jessica L. Hendricks, Management Intern <br /> <br />Background: <br /> <br />On May 13,2010 the City received a request from Doris Griep, owner ofE1 Gato con Botas <br />Learning Center, for a conditional use permit (CUP) to operate a daycare/preschool in the <br />Planned Unit Development (PUD) District at the property generally known as 5400 140th <br />Avenue NW. <br /> <br />Notification: <br /> <br />In accordance with State Statute, staff attempted to notify all property owners within 350 feet of <br />the subject property of the request via standard US Mail. <br /> <br />Observations: <br /> <br />The Applicant plans to create a Spanish immersion preschool/daycare called El Gato con Botas <br />Learning Center for children ages three (3) to five (5) years. The proposed hours of operation <br />will be from 6:00 am to 6:00 pm. The preschool/daycare will offer Spanish language and <br />cultural instruction. <br /> <br />The Applicant proposes to locate the daycare/learning center in a multitenant building on the <br />northeast comer of Bunker Lake Boulevard and Dysprosium Street NW. The tenant space at this <br />location is 2,942 square feet, and will be made up of four (4) classrooms, three (3) restrooms, a <br />staff lounge, and office area. Using the Minnesota Department of Health's formula to determine <br />maximum occupancy for a daycare center, the proposed tenant space on the subject property <br />would allow for roughly sixty-two (62) children (2,200 square feet of classroom space @ 35 <br />square feet per child). However, the Applicant has stated that the daycare will be limited to <br />forty-five (45) students. <br /> <br />As a part of the remodel work for the daycare/preschool, the Applicant also proposes to create a <br />playground area on the southeast side of the building. The playground will be constructed on <br />grass and a portion of the existing parking lot space. The play area will be enclosed with six by <br />eight foot treated timbers, with grooves cut into them for drainage. This area will then be filled <br />in with playground mulch and surrounded by a chain link fence. The resulting play area will be <br />approximately 2,000 square feet, exceeding the state requirement of 1,500 square feet. <br /> <br />The subject property is zoned Planned Unit Development. The PUD for this subdivision <br />specifies that the Subject Property shall be allowed the uses under the B-1 General Business <br />District and daycare centers are listed as a conditional use in this district.
