<br />1.10 Service Plan. "Service Plan" means the plan for providing transit service under the <br />agreement as set forth in Exhibit A which is attached to and incorporated into the agreement. <br />The Service Plan also includes the route map and schedule published or approved by the City <br />Council and in effect for each such route, copies of which are on file with the City Council. In <br />the event of any conflict between the provisions of Exhibit A and the published or approved <br />route map and schedule, the published or approved route map and schedule shall prevail. The <br />Service Plan describes the trips to be provided by the Contractor under the agreement and <br />includes the NTD Revenue Hours for contiguous sets of such trips, the trip routes, time points on <br />the trips, and In-Service Hours for each trip, all as determined by the City Council. The Service <br />Plan also includes any revisions in the Service Plan provided to the Contractor by the City <br />Council pursuant to section 2.02. <br /> <br />1.11 Total Missed Trip. A "Total Missed Trip" means a trip specified in the Service <br />Plan in which the transit vehicle operated by the Contractor does not arrive at one or more time <br />points on the trip within twenty minutes after the time specified for such time point. <br /> <br />1.12 Total Missed Trip Credit. The "Total Missed Trip Credit" attributable to a Total <br />Missed Trip is calculated by multiplying the number of In-Service Hours specified in the Service <br />Plan for the trip, times the applicable Contractor hourly rate (as specified in section 7.01) at the <br />time the Total Missed Trip occurred. <br /> <br />1.13 Partial Missed Trip. A "Partial Missed Trip" means a trip specified in the Service <br />Plan which does not meet the definition of a Total Missed Trip but in which the transit vehicle <br />operated by the Contractor does not arrive at one or more time points on the trip within ten <br />minutes after the time specified for such time point. <br /> <br />1.14 Partial Missed Trip Credit. The "Partial Missed Trip Credit" attributable to each <br />Partial Missed Trip is calculated by multiplying the longest late time (measured in hours) by <br />which the Contractor failed to arrive at a time point during the Partial Missed Trip, times the <br />applicable Contractor hourly rate (as specified in section 7.01) at the time of the Partial Missed <br />Trip. <br /> <br />1.15 Americans with Disabilities Act. "Americans with Disabilities Act" or "ADA" <br />means the federal Americans with Disabilities Act of 1990,42 D.S.C. sections 12101 et seq., and <br />as such law may be amended from time to time. <br /> <br />II. BASIC SERVICES <br /> <br />2.01 Contractor's Responsibilities. During the term of the agreement, the Contractor <br />agrees to provide those transit services specified in the Service Plan in a safe, efficient, and <br />economical manner. The Contractor shall coordinate, manage, provide for, and control all <br />activities needed to operate those transit services described in the Service Plan. The Contractor's <br />responsibilities include, without limitation: operating and scheduling vehicles and personnel, <br />providing customer service, maintaining equipment, developing administrative procedures, <br />compiling performance statistics and financial reports, developing methods to maximize service <br />effectiveness and efficiency, distributing pocket schedules, and providing all ancillary and <br /> <br />5 <br />
