<br />and all revenue produced from such advertising or informational material. The Contractor shall <br />not place any advertising or informational material of any kind or nature on transit vehicles used <br />in providing service under the agreement without the express written consent of the City <br />Council. <br /> <br />III. CONTRACTOR PERSONNEL <br /> <br />3.01 Employment of Personnel. The Contractor shall supply and furnish all personnel <br />that are necessary for the safe, sound, and efficient delivery, operation, street and administrative <br />supervision, and maintenance of, and fare collection for, the transit service provided under the <br />agreement and the vehicles and equipment used in providing such service. The Contractor shall <br />be responsible for all recruitment, screening, testing, selection, training, scheduling, supervision, <br />discipline, termination, and other functions related to such personnel. The Contractor's driver <br />selection procedures shall include a background reference check and criminal history check for <br />all driver applicants before hiring. <br /> <br />The Contractor shall comply with all applicable federal, state, and local labor laws including, <br />without limitation, any and all laws relating to the minimum wages to be paid its employees, <br />limitations upon the employment of minors, the payment of wages due employees, and all <br />applicable regulations established to protect the health and safety of employees. <br /> <br />3.02 Personnel Requirements. In employing personnel to provide transit services <br />under the agreement, the Contractor shall obtain and utilize the services of trained, qualified, and <br />licensed drivers meeting all applicable standards and requirements of federal, state and local law <br />and regulations and as necessary for the safe operation of transit vehicles used in providing the <br />service. The Contractor shall establish an information and safety meeting policy providing a <br />means of instructing drivers on safety issues and updating drivers on administrative procedures <br />relating to services provided under the agreement. The Contractor shall ensure that all personnel <br />providing transit services, including any subcontractors' employees: <br /> <br />· know and understand the transit system design, <br />· wear a badge on the outer layer of clothing that identifies the Contractor and that <br />identifies the employee by name or operator number, <br />· have attire free of tears and holes, <br />· maintain a neat and clean appearance, and <br />· maintain a courteous attitude, answering to the best of their ability any passenger <br />questions regarding the provision of service. <br /> <br />The Contractor is responsible for the satisfactory work performance of all personnel providing <br />services under the agreement. <br /> <br />3.03 Alcohol Misuse and Prohibited Drug Use Testing Program. The Contractor <br />agrees to establish, implement, and maintain a drug and alcohol testing program that complies <br />with Federal Transit Administration regulations on "Prevention of Alcohol Misuse and <br />Prohibited Drug Use in Transit Operations" (49 CFR Part 655) and "Procedures for <br />Transportation Workplace Drug and Alcohol Testing" (49 CFR Part 40).
