<br />provisions of this section and to allow access to and audit of such information in accordance with <br />sections 6.05 and 6.06. <br /> <br />6.05 Access to Data and Other Information. The City shall have access to all <br />Contractor data under the agreement and shall cooperate with the City's reasonable requests for <br />access to the data. The Contractor must maintain the data in convenient formats reasonably <br />requested by the City. The term "data" for the purposes of this section includes all information <br />and records collected, created, received, maintained, or disseminated by the Contractor in <br />providing services under the agreement, regardless of physical forril, storage media, or <br />conditions of use. <br /> <br />Upon request, the Contractor shall, in a timely fashion, furnish to the City copies of all reports <br />required by law or regulation to be furnished to the City or any other governmental body or <br />authority having legal jurisdiction over operational matters of the Contractor. The Contractor <br />shall, at the end of the term of the agreement or upon earlier termination, turn over in a timely <br />fashion any and all records that are requested by the City. <br /> <br />6.06 Audits. The accounts and records of the Contractor relating to the agreement shall <br />be audited in the same manner as all other accounts and records of the Contractor are audited. <br />During the time of maintenance of information under section 6.04, authorized representatives of <br />the City, and the Legislative Auditor and/or State Auditor in accordance with Minnesota <br />Statutes, section 16C.05, subdivision 5, will have access to all such books, records, documents, <br />accounting practices and procedures, and other information for the purpose of inspection, audit, <br />and copying during normal business hours. The Contractor will provide proper facilities for such <br />access and inspection. <br /> <br />Within thirty (30) calendar days after completion, the Contractor shall deliver to City a copy of <br />any financial or operational audit of the Contractor done by the Contractor or at its request or at <br />the direction of any governmental agency or department which relate to the transit services <br />provided under the agreement. <br /> <br />6.07 Data Practices Act Compliance. In accordance with Minnesota Statutes, section <br />13.05, subdivision 11, all of the data created, collected, received, stored, used, maintained, or <br />disseminated by the Contractor in performing the services under the agreement is subject to the <br />requirements of the Minnesota Government Data Practices Act. The Contractor must comply <br />with those requirements, and the civil remedies of Minnesota Statutes, section 13.08, apply to <br />the Contractor. <br /> <br />The Contractor shall promptly refer to the Project Administrator any third-party requests for <br />release of or access to Customer information, records, or other data collected, created, received, <br />maintained, or disseminated by the Contractor in providing services under the agreement, <br />regardless of physical form, storage media, or conditions of use. <br /> <br />VII.
