Director of Public Works Olson stated we are on the second extension of five, six-month <br />extensions. He continued what if we go out for an RFP, only one person responds, and it's <br />higher than the one we currently have. <br />City Administrator Ulrich stated we still have the option of sticking with our current contract. <br />Mr. Olson added but every six months you have the ability to negotiate. <br />Councilmember Look asked how the RFP could be simplified. <br />Different options were discussed -Volt, Robinson, Laidlaw, Lorenz .. . <br />Mr. Olson stated that the RFP's going out are all meeting federal guidelines and talked about <br />federal dollars and that it could be reimbursable. He stated he did not want to preclude us from. <br />any federal dollars. <br />5) Discuss Recreational Vehicle Ordinance & ATV Trails <br />Police Chief Way stated that the City's recreational vehicle ordinance was changed and Council <br />directed staff to come back and present a recap of how things went. Some snowmobile trails <br />were opened up.in the City and for the most part, we did not have any problems. He presented <br />the number of complaints and number of tickets and explained that the slight difference in <br />numbers is basically due to the amount of snow cover. He stated a County trail had been <br />mapped. He expressed some concern about all the signage put up that had to be taken down and <br />the amount of time it took to do so made it seem counterproductive. He reported there was no <br />wear, no tear, and no issues with the golf course. <br />Chief Way continued that recreational vehicles were discussed during the Council/staff strategic <br />planning session and Council had inquired if staff looked at trails across the City. State Statutes <br />does not allow ATV trails along Trott Brook. We can allow ATV's on City streets but we would <br />have to issue City permits to do so and we cannot grant permission for County roads, as we do <br />not have jurisdiction over them. He referenced the State Statute 169.045, dealing with what the <br />City would have to go through for the permitting process. He added that we cannot allow riding <br />of ATV's at night -only sunrise to sunset. <br />Mayor Ramsey expressed his preference would be to open the City up to ATVs. He would like <br />to move forward and challenge the State Statute. He alluded to the sunrise/sunset stipulation and <br />suggested that if this is the case, then we would need to outlaw bicycles in the City after dark. <br />Councilmember Jeffrey wasn't sure he was interested in challenging State Statutes and expressed <br />concern about enforcing the sun up to sun down regulation. He noted other restrictions as well <br />that would make it tough for our residents. <br />Mayor Ramsey pointed out some flaws in the law and felt that doing nothing about it is not an <br />option. <br />City Council Work Session -June 1, 2010 <br />Page 6 of 11 <br />
