He stated he was willing,Yo <br />comply with the City's requirements and both he and his wife were anxious to move out of the <br />hotel room they were currently in. <br />Councilmember Elvig stated he understood Mr. Belrose's situation. He asked if the City could <br />use its resources to get the building secured and bill the insurance company directly instead of <br />putting an assessment on the property. <br />Mr. Belrose stated if this suggestion made the structure safer sooner, he would agree to this. He <br />stated his only concern was that he wanted to recover some of his personal items, but needed <br />contractor assistance with this. <br />Councilmember Elvig assured Mr. Belrose that the contractor the City would use would be <br />willing to work with Mr. Belrose on recovering his personal items. <br />City Attorney Goodrich stated within the Statute there was a provision where the City could <br />remove the property by consent and the costs would be assessed against the property and <br />hopefully the insurance company would pay the assessment. Otherwise, the assessment would <br />be for five years at eight percent interest. <br />Mr. Belrose asked if he could get a time extension to get the insurance company to act on this. <br />City Attorney Goodrich noted time was of the essence now and the City had to move on this <br />within the next few days. <br />Acting Mayor Look noted the issue now was liability. He believed Mr. Belrose should be able to <br />work with either his contractor or the City's contractor to get his personal items out of the house. <br />City Attorney.Goodrich recommended the Council tabling the order to give time for Mr. Belrose <br />to work with staff and the City Attorney on obtaining a contractor and to sign documents that <br />Mr. Belrose would be willing to do this or the clean up would be assessed against the property. <br />Mr. Belrose asked if the other remaining walls could be collapsed in so the walls did not fall on <br />anyone. He stated his priority was the safety of the community and not his personal possessions. <br />Fire Chief Kapler stated the .Fire Department was not in the demolition business and he <br />recommended this be handled by a demolition expert. <br />Motion by Councilmember Elvig, seconded by Councilmember Jeffrey, to adopt Resolution #10- <br />06-135 ordering the razing of a hazardous building located at 13670 Garnet Street NW, Ramsey, <br />Minnesota, but service of the order is stayed pending entering into a consent agreement to abate <br />the hazardous building requiring substantial cleanup including removal of any hazardous <br />materials, and fencing the property to minimize access to the hazardous building area, all to be <br />done on or before 5:00 p.m., June 26, 2010. <br />City Council /June 22, 2010 <br />Page 8 of 11 <br />
