MRCC4 News January 2010 <br />Issue 1 <br />INinnesote <br />IEPARMEn10F <br />.1URAE R90JW <br />In this issue: <br />Rulemaking Project Underway <br />Rulemaking Process Overview <br />Progress to Date <br />Work Groups Forming Soon <br />MRCCA Rulemaking Project Underway <br />The DNR has commenced rulemaking for the Mississippi River Corridor <br />Critical Area (MRCCA) as directed by the 2009 Legislature. The MRCCA <br />comprises a 72 -mile corridor that was designated a state critical area by <br />Executive Order in 1976. The Executive Order was reaffirmed and made <br />permanent in 1979. The corridor includes the Mississippi River and <br />adjacent land spanning the Twin Cities metro area from Dayton and <br />Ramsey in the north to the St. Croix River and the Dakota -Goodhue <br />county line in the south. Most of the 30 local governments with <br />jurisdiction in the MRCCA have developed plans and zoning ordinances to <br />guide land use consistent with the districts and performance standards <br />established in the 1979 Executive Order. However, policies, standards, <br />and administration vary among these communities. <br />Per the 2009 legislation, the DNR must establish, by rule, new districts <br />within the MRCCA, and new guidelines and minimum development <br />standards for each district. The new rules must address regulatory <br />objectives while providing maximum flexibility for the regulated party <br />and the agency in meeting those objectives. <br />The DNR has developed a process outline for the MRCCA rulemaking <br />project consistent with Minnesota Statutes, Chapter 14 as provided <br />below.
