I <br /> I <br /> I <br /> ! <br /> I <br /> I <br /> i <br /> I <br /> ! <br /> ! <br /> I <br /> I <br /> I <br />!1 <br /> I <br /> I <br /> I <br /> I <br /> <br />CASE #: q <br /> <br /> REQUEST FOR FINAL PLAT APPROVAL OF <br /> HIGHLANDS AT RIVER PARK 3rd ADDITION; <br /> CASE OF ARCON DEVELOPMENT <br />By: Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />On September 11, 2001, the City Council approved the preliminary plat for Highlands at River Park. <br />The approved preliminary plat consists of 157 single family urban residential lots proposed to be <br />developed in 3 phases. On February 26, 2002, the City Council gioanted final plat approval to the <br />first phase which consisted of 58 lots. On June 25, 2002, the City Council approved the second <br />phase which consisted of another 64 lots. On March 24, 2003, the City received an application for <br />final plat approval of the final 35 lots remaining in the approved preliminary plat. The following <br />items are enclosed: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br />f) <br />g) <br />h) <br /> <br />Site location map <br />Proposed final plat <br />Grading, Drainage & Erosion Control Plan <br />Construction Plans <br />Arcon request for extension to preliminary plat approval dated May 1, 2003 <br />City Staff Review Letter dated June 6, 2003 <br />Proposed development agreement <br />Proposed resolution for extension of preliminary plat approval and final plat approval <br /> <br />Notification: <br /> <br />No public hearing is required at the final plat stage of a subdivision. <br /> <br />Observations: <br /> <br />City Code states that preliminary plats are valid for one year from the date of approval. The <br />preliminary plat for Highlands At River Park was approved on September 11,2001, and expired on <br />September 1 I, 2002. Only 2 of the 3 phases of Highlands At River Park had been final platted <br />within that one year time frame, which is an aggressive schedule. Therefore, the developer needs an <br />extension to the preliminary plat approval in order to obtain final plat approval of the final phase of <br />Highlands. City Staff supports the request for an extension to the preliminary plat approval. In <br />addition, City Staff has incorporated language into the draft amendment to the Zoning and <br />Subdivision regulations to allow the City the flexibility to grant preliminary plat approvals beyond <br />the one year time frame when the project has an approved phasing plan that will require more than <br />one year to complete. <br /> <br />All 35 lots conform to the sizes and dimensions approved on the Preliminary Plat. This phase of <br />Highlands will receive public street access by the extension of 155th Lane N.W. to the east and <br />Waco Street N.W. to the north. <br /> <br />The standard drainage and utility easements have been provided around the perimeter of all lots. All <br />other drainage facilities are also encumbered with easements. <br /> <br />-167- <br /> <br /> <br />
