19. <br /> <br />20. <br /> <br />and the associated costs shall be the responsibility of the homeowner's association. <br />CITY expenses incurred in sweeping the private streets and/or driveway collectors shall <br />be paid within thirty (30) days of billing. Failure to compensate the CITY for the <br />services shall be cause for a special assessment to be levied against the Plat and certified <br />to the County Auditor for collection in the manner as taxes and special assessments are <br />certified and collected. The DEVELOPER herein grants permission and a license to the <br />CITY or its contractors and assigns to enter upon the Plat for the purpose of cleaning the <br />private streets and/or driveway collectors. The DEVELOPER shall also be responsible <br />for including these provisions in the covenants drafted as a part of the homeowner's <br />association. <br /> <br /> SECTION III <br />PERMITS AND OCCUPANCY <br /> <br />Requirements for Building and Occupancy Permits. No building permit for any lot in <br />the Plat shall be issued until: (a) a Class V driving surface is installed to within 300 feet <br />of the structure: (b) a Certificate of Survey, including that survey information required <br />by the CITY has been supplied to the City Building Official; (c) all the f'mancial <br />guarantees required by the CITY have been.satisfied; (d) the DEVELOPER has supplied <br />the CITY with a copy of the Lower Rum River Water Management Organization permit. <br />The CITY reserves the right to suspend all building activities upon the CITY being <br />notified by an outside agency that the appropriate permit(s) was not obtained from the <br />applicable agency. Approval of the building foundation requires a certificate of elevation <br />signed by a licensed (State of Minnesota), professional land surveyor, verifying that the <br />elevation complies with the approved grading plan for the Plat. The lowest floor <br />elevation shall be at least 2 feet above the 100 year elevation. <br /> <br />No occupancy permit for any lot in the Plat shall be issued until: (a) vehicular access to <br />the lot is provided including the installation of at least one laYer of bituminous surfacing; <br />(b) all utilities are in place, operational and accepted by the CITY. (c) the CITY has been <br />provided with a certificate of grading for any lot with a slope flatter than 2%. <br /> <br /> SECTION IV <br />PARK DEDICATION <br /> <br />Park Dedication. The Subject Property is located within the Prairie Recreation District. <br />Park Dedication shall consist of the dedication of 1.05 acre park located in the Southwest <br />comer of the plat. The balance of Park Dedication shall consist of a cash payment of <br />Thirty Five Thousand Seven Hundred Dollars and no cents ($35,700) to be deposited in <br />the Solstice Park development fund. In addition to the dedication, of land and the cash <br />payment, the CITY and the DEVELOPER shall cooperate on the Stage 1 improvements <br />listed below. Items 2, 5, and 6 may be credited against Park Dedication owed if <br />completed in a timely fashion and to City standards. However, unless agreed to by a <br /> <br />-141- <br /> <br /> <br />
