I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> 1 <br />,I <br />'1 <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Zimmerman, to adopt <br />Resolution #02-03- adopting Findings of Fact # relating to the request for a <br />conditional use permit. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Zimmerman, <br />Anderson, and Kurak. Voting No: None. <br /> <br />Councilmember Hendriksen inquired if they were waiving the curbing requirement when the <br />overlay is completed. <br /> <br />Community Development Director Frolik explained that the curbing could adversely impact the <br />drainage, which is why it was being waived. <br /> <br />Councilmember Kurak inquired as to what the land use for the property was in the December <br />2001 Comprehensive Plan. <br /> <br />Community Development Director Frolik replied that the land use is places to shop. <br /> <br />The Council discussed the leasing of the property. <br /> <br />Councilmember Kurak inquired if the lease was already entered into or was it contingent on <br />receiving the conditional use permit. <br /> <br />Douglas Roberts replied that it would be contingent upon receiving approval of the conditional <br />use permit. <br /> <br />Councilmember Kurak inquired as to what would happen if the lease does not go forward. <br /> <br />Community Development Director Frolik explained that the conditional Use permit would be <br />specific to the types of manufacturing that Mr. Roberts does. <br /> <br />City Attorney Goodrich noted that the conditional use permit will only be good for a year if it is <br />not acted on. <br /> <br />Councihnember Kurak inquired if the lease were not go forward and then they decide to do <br />something on the property that contains a lot of truck traffic, would that be allowed. <br /> <br />Councilmember Hendriksen replied that any use would have to comply with the uses in the <br />conditional use permit. <br /> <br />Councilmember Zimmerman inquired as to how many trucks they expect to be coming from the <br />site. <br /> <br />Mr. Roberts explained that there will probably only be one small delivery truck a week. <br /> <br /> City Council/March 26, 2002 <br /> Page 11 of 25 <br /> <br />-29- <br /> <br /> <br />
