I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />AUTHORIZATION TO LEVY CIVIL PENALTIES <br /> By: Interim Police Chief, Jim Way <br /> <br />Background: <br /> <br />Since April of 2002, the Ramsey Police Department has performed alcohol compliance <br />checks at all businesses in Ramsey that sell alcohol. Six businesses failed the compliance <br />check and sold to underage persons. The Ramsey Police Department is requesting <br />authorization from the City Council to send letters to the business licensee that failed <br />advising them that they are being assessed a $500.00 civil fine and a one day suspension <br />as outlined in Ramsey City Code. <br /> <br />Recommendation: <br /> <br />Staff recommends the Ramsey Police Department be authorized to send certified mail <br />notifications to the licensee of the businesses that failed the compliance checks. The <br />letter will include the notification of the $500.00 civil fine amount and one day <br />suspension for first time violators and notification of their right to a hearing. <br /> <br />Council Action: <br /> <br />Motion by the council to adopt resolution 02-11-XXX, authorizing the Ramsey Police <br />Department to notify the six business licensees that failed compliance checks of a <br />$500.00 civil fine and 1 day suspension for the alcohol Compliance check failure. <br /> <br />Reviewed by: <br /> <br />City Administrator <br />City Attorney <br /> <br />CC: 11/12/2002 <br /> <br />-117- <br /> <br /> <br />
