I
I
I
I
I
I
I
I
I
I
I
I
!
I
!
I
I
I
I

~ouncilmember Hendriksen stated that since the action is to introdUce the ordinance would it
make sense to introduce the ordinance this evening and then do the homework prior to adoption.

Councilmember Anderson replied that she felt that it woUld be pushing the issue somewhat. She
stated that there were so many questions left unanswered such as under What circumstances does
~e City have to purchase right of way or land. She wanted to know more about the process
*~efore proceeding.

~2ouncilmembe~ Hendriksen felt that they could aCcomplish that by introducing the Ordinance
rind then if Councilmember Anderson did not have all of her answers she could vote no at the
time of adoption.

City Attorney Goodrich explained that one the purposes for placing a moratorium on property is
to protect the planning process while considering the process of official controls, such as official
maps.

Councilmember Anderson stated that she did not think that they would have all the answers
about the official mapping process'in two weeks.

Councilmember Hendriksen stated that the purpose of the moratorium is to have a "time out" to
consider the official mapping process. At this time they don't know what the outcome will be.

City Attorney Goodrich stated that it could be that during the moratorium process the Council
might find that the official mapping process is not for them or they might find that it is
appropriate. What the City is looking at doing is holding off on any further deVelopment until
that decision is made.

Councilmember Anderson stated that it seems that the COuncil is not sUre what kind of
moratorium they want.

'City Attorney 'Goodrich stated that the Council will establish parameters for the moratorium and
then during the moratorium they will decide what type of official mapping the want. At' this time
they were not deciding what kind of official map they want or what the contents of that will be or
even if they want one.

Mayo 'Gamec stated that the City could simply ignore' what might happen in the future and let
the St · ::e deal with it, but more than likely the City will have to be involved anyway.

City Attorney Goodrich vnted that in the past when the Council has adopted moratorium
ordinances they have adopted them for less than 12 months.

Councilmember Hendriksen replied that when that has been done in the past it affected the
maximum number of months a moratorium is allowed. H'e stated that if they adopt the initial
moratorium for less than 12 months it reduces the maximum amount of time.

City Council/October 22, 2002

-153-
