-302- <br /> <br />The City agrees to allow the Developer to utilize all of the trunk fee money <br />generated from this fu:st phase of 44 lots as well as an additional 156 lots that will <br />be platted in the future on land under the Developer's control within the "triangle" <br />during a five year period following the date of final approval of Villas of Meadow <br />Point. The "triangle" is defined by the right-of-ways of Alpine Dr. NW, County <br />Road 5 (Nowthen Blvd.), and County Road 57 (Sunfish Lake Blvd.). <br />The trunk fee money that the City is allowing the Developer to utilize is to be <br />used to construct the 30" trunk sanitary sewer line through the site and across <br />County Road 5 at a depth and alignment as approved by the City Engineer. <br />If the cost to construct the above mentioned 30" tnmk sanitary sewer line through <br />the site plus a 25% increase for design, contract administration, legal, and <br />contingency is below that which will be generated from tnmk fees, then the <br />difference will be due to the City from the Developer upon final platting of a <br />subsequent phase. <br /> <br />On October 11, 2002, the City of Ramsey received notification from the Minnesota <br />Environmental Quality Board that a valid citizen petition requesting that the City require an <br />Environmental Assessment Worksheet (EAW') be completed for Villas of Meadow Point. The <br />petition raises three potential environmental effects that could occur with the Villas of Meadow <br />Point development; 1) Harm to the natural habitat of the Blanding's Turtles, 2) Reduction of the <br />habitat for other wildlife, 3) Decline of water quality and supply. Under State law, the City <br />Council cannot make any £mal government approvals of a project until the need for an EAW has <br />been determined. State statutes allow for the City Council to take up to 30 working days to make <br />a decision. The developer, in response to the petition, has indicated that they will be bringing <br />forward information addressing the citizen petition's concerns at the October 22, 2002 City <br />Council meeting. Under State law, the City has 30 working days to make a determination on <br />whether an EAW shall be conducted. <br /> <br />Recommendation: <br /> <br />The first item that the City Council must consider is to make a decision on the citizen petition. <br />The City Council may want to consider several options; <br /> <br />¸2. <br /> <br />Motion to table action on the plat in order to conduct a review of the environmental issues <br />raised as part of the citizen petition. As part of this motion, the City Council should instruct <br />staff' to h/re an independent consultant to review the citizen petition and provide guidance to <br />the City Council. <br /> <br />Motion to adopt findings of fact that determine that an EAW is not needed for the Villas of <br />Meadow Point subdivisions. Staff will bring basic findings of fact to the meeting for the <br />Council to consider if this is the preferred option. Additional findings will need to be added <br />by the City Council <br /> <br />Motion to adopt the preliminary plat contingent that, among other things, the City Council <br />makes a determination at a future meeting that an EAW is not necessary or warranted for the <br />Villas of Meadow Point subdivision.
