I <br /> <br />SECTION 4. UNDUE HARDSHIP EXCEPTIONS <br /> <br />The City Council may. grant an exception to the provisions of this Ordinance when, in its <br />opinion, undue hardship or a practica[ difficulty may resUlt from strict compliance. In granting <br />an exception, the City Council shall prescribe any conditions that it deems necessary to or <br />desirable for the protection of thepublic interest. NO exception shall be granted unless the City <br />Council finds: <br /> <br />1. That there are special circumstances or conditions affecting said property ~such that the <br /> strict application of the provisions of this Moratorium Ordinance would deprive the <br /> petitioner of the reasonable use of petitioner's land. <br /> <br />2. That the exception is necessary for the preservation and enjoyment of a substantial <br /> property right of the petitioner. <br /> <br />That the granting of the exception will not be detrimental to the public welfare or <br />injurious to other property in the area in which the property is situated. <br /> <br />-435- <br /> <br /> <br />
