The cumulative effects of the above mentioned subdivisions
along with the additional units associated with Villas of Meadow Point were evaluated for its
impact on the three major intersections, which include TH 47 and Alpine Drive, CSAH 5 and
Alpine Drive, and CR 57 and Alpine Drive. Each of these intersections currently operates at a
high level of service, even during the AM and PM peaks. The additional traffic generated
from the surrounding developments are not expected to deteriorate the level of service of the
intersections after full build-out.

At the October 8, 2002 City Council work session, the City Council agreed in concept to a
funding arrangement that was proposed by the Developer. The funding proposal that the City
Council conceptually agreed to is as follows:

The City agrees to contribute a not to exceed amount of $150,000.00 to the cost
of constructing a 30" trunk sanitary sewer line from its existing location to the
north right-of-way of Alpine Dr. NW.
The City agrees to allow the DevelOper to utilize all of the trunk fee money
generated from this first phase of 44 lots as well as an additional 156 lots that will
be platted in the future on land under the Developer's control within the "triangle"
during a five year period following the date of final approval of Villas of Meadow
Point. The "triangle" is defined by the right-of-ways of AlPine Drive NW, County
Road 5 (Nowthen Boulevard.), and County Road 57 (Sunfish Lake Boulevard.).
The trunk fee money that the City is allowing the Developer to utilize is to be used
to construct the 30" trunk sanitary sewer line through the site and across Co, unty
Road 5 at a depth and alignment as approved by the City Engineer.
If the cost to construct the above mentioned 30" trunk sanitary sewer line through
the site plus a 25% increase for design, contract administration, legal, and
contingency is below that which will be generated from trunk fees, then the
difference will be due to the City from the Developer upon final 'platting. of a
subsequent phase.

On October 11, 2002, the City of Ramsey received notification from the Minnesota
Environmental Quality Board that a valid citizen petition requesting that the City require an
Environmental Assessment Worksheet (EA, W) be completed for Villas of Meadow Point. The
petition raises three potential environmental effects that could occur with the Villas of Meadow
Point development; 1) Harm to the natural habitat of the Blanding's Turtles, 2) Reduction of the
habitat for other wildlife, 3) Decline of water quality and supply. Under State law, the City
Council cannot make any final government approvals of a project until the need for an EAW has
been determined. State Statutes allow for the City Council to take up to 30 working days to
make a decision. The developer, in response to the petition, has indicated that they will be
bringing forward information addressing the citizen petition,s concerns at the October 22, 2002
City Council meeting. Under Statelaw, the City has 30 working days to make a determination on
whether an EAW shall be conducted. The first item that the City Council must consider is to
make a decision on the citizen petition. The City Council will need to make a decision on whether

City Council/October 22, 2002

-225-
