Of the 40% open space, 10% of the open space is required to be grouped <br />together in a way that is easily identifiable. You have indicated that in a future phase, you will be <br />constructing a commumty building that will serve the residents of'this development. The City will <br />count this as meeting the 10% common space requirement. However, if the commumty building is <br />not built, you will be responsible for creating the required common space in future phases. <br /> <br />5. Streets: The plat proposes public street access from Alpine Dr. (formerly 153'a Ave.), a City <br /> Municipal State Aid road. Driveway access for the single family lots have been removed from <br /> Alpine Dr. as directed by the City Council on October 22, 2002. This plat contains a private street <br /> and two common driveways servicing the townkomes. The private street complies with the City <br /> standards for such roadways. <br /> <br />· 6. Grading and Drainage: Staffhas reviewed the drainage and grading plan Contained on'Sheet 2 of 9 <br /> of the construction plans and finds them acceptable. <br /> <br />Utilities and Water Usage: The development will be served by municipal water and sanitary <br />sewer. As part of the development, the developer will be constructing sanitary sewer trunk <br />through the plat. At previous City Council meetings, the City agreed to do the following in <br />regards to the sanitary sewer trunk line: <br /> <br />The City agrees to contribute' a not to exceed amount of $150,000.00 to the cost <br />of constructing a 30" trunk sanitary sewer line from its ex/sting location to the <br />north right-of-way of Alpine Dr. NW. <br />The City agrees to allow the Developer to utilize all of the trunk fee m. oney <br />generated from this first phase of 44 lots as well as an additional 156 lots that will <br />be platted in the future on land under the Developer's. control within the "triangle" <br />during a five year period following the date of final approval of Villas of Meadow <br />Point. The "triangle" is defined by the right-of-ways of Alpine Dr. NW, County <br />Road '5 (Nowthen Blvd.), and: County Road 57 (Sunfish. Lake Bird:). <br />The trunk fee money that the City is allowing the Developer to utilize is to be used <br />to construct the 30" trunk sanitary sewer line through the site and across County <br />Road 5 at a depth and alignment as approved by the City Engineer. <br />If the Cost to construct the above mentioned 30" trunk sanitary sewer line through <br />the site plus a 25% increase for design, contract administration, legal, and <br />contingency is below that which will be generated from trunk fees, then the <br />difference will be due to the City from the Developer upon final platting of a <br />subsequent, phase. <br /> <br />The above language is contained in the development agreement governing Villas of Meadow <br />Pointe subdivision. <br /> <br />In regards to the final utility plan, staffhas the following additional comments: <br /> <br />-233- <br /> <br /> <br />
