Councilmember introduced the following resolution and moved for its adoption: #02-08- RESOLUTION FINDING NO DISCIPLINE REGARDING A CITY EMPLOYEE WHEREAS, on July 23, 2002 the City Council received a citizen complaint regarding the conduct of a City employee subject to the City Council's authority; and WHEREAS, pursuant to Minn. Stat. § 13D.05, Subd. 2 "Meetings having data classified as not public," the City Council is obligated to close the meeting at which it undertakes preliminary consideration of allegations on charges against an individual subject to its author/ty, unless said individual requests that the meeting be open; and WHEREAS, the individual that is the subject of the allegation did not request that the meeting.be open; and WHEREAS, the City Council held a closed meeting on August 13, 2002 to discuss the allegations made against the individual; and WHEREAS, a majority of tl/e City Council has concluded that the allegations are not cause for discipline of the employee. NOW THEREFORE, BE IT RESOLVED BY THE R,42vISEY CITY COUNCIL as follows: 1. That the allegations against a City employee presented to the City Council on July 23, 2002 by a citizen are not cause for discipline and that discipline is not warranted. 2. That the matter is closed.
