AGREEMENT BETWEEN THE DEVELOPERS <br /> STOlta'~I SEWER TRUNK <br /> <br />THIS AGREEMENT is made effective as of the 4th day of June, 2002, by and. bcwween Edina <br />Development Corp., Inc., 700 Industry Avenue, Anoka, MN 55303, Oakwood Land DevelopmenL <br />Inc., 1611 Highway I0, NE, Spring Lake Park, MN 55432, and Total Freedom Corporation of <br />Ramsey, 15596 St. Francis Boulevard, Ramsey, ~ 55303, hereinafter re/erred to as the <br />Developers. <br /> <br />The Developers agree to enter into a Contract with John Oliver & Associates, Inc., for the design and <br />construct/on related services associated with construction of a storm sewer trunk in the City of <br />Ramsey, Minnesota. The Developers a/so agree to enter into a second Contract w/th an unnamed <br />Utility Contractor who will construct the storm sewer mink and who will be selected through a <br />bidding process. <br /> <br />Costs for the storm sewer trunk project design and construction will be shared between the <br /> <br />Developers based on the following schedule: <br /> <br />Edina Development Corp. Inc. <br />Oakwood Land Development, Inc. <br />Total Freedom Corporation of Ramsay <br /> <br />37.,8% <br /> <br />Each Developer will be respons/ble for paying their share of the design and construction costs <br />dkectly to John Oliver & Associates, Inc. <br /> <br />Edina Development Corp. will take a lead role in managing the project and John Oliver &: <br />AsSociates, Inc. will provide an Owner's Representative at critical times, such as the preconstmction <br />meeting, or as needed in order for the project to proceed. Contract Amendments must be approved <br />by' all three Developers. <br /> <br />Oakwood Land Development, Inc. and Total Freedom Corp. of Ramsey will reimburse Edina <br />Developme,ut Corp., Inc.
