One is that east of the building there is catch basin and without curbing
they will have a difficult time keeping the basin and the pipe clean. Secondly the curbing would
help keep vehicles from driving on the eastern portion of the site.

Gary Demly, 1433 Utica Street, Minneapolis, Architect, stated that he thought that there were
other ways they could handle the concerns without installing curbing.

Mayor Gamec replied that the Council have to take the recommendation from the City Engineer.

Mr. Demly stated that he would like the opportunity to research the other possibilities and
discuss them with staff.

City Engineer Olson stated that he was sure that there were ways to accomplish his concerns
without curbing, which might be paving the area that is draining to the catch basin.

City Attorney Goodrich noted that the motion would be contingent upon a lot of issues so it
could come back for review in a couple weeks.

Motion by Councihnember Hendriksen, seconded by Councilmember Zimmerman, to table
action to allow the applicant time to work out issues with City staff and bring the case back for
consideration once those issues are resolved.

Further discussion: Councilmember Zimmerman stated that the Highway Department is
studying the possibility of converting Highway #10 to a freeway and inquired as to what liability
the would City incur if that were to occur in the future. City Attorney Goodrich replied that
someone would have to buy them out to acquire the property, but at this time it is unclear as to
who that would be.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Zilnmerman,
Anderson, and Kurak. Voting No: None.

Case #6:

Request to Rezone Property From R-1 Urban Residential to R-3 Urban
Residential; Case of Anoka County Community Action Program (ACCAP)

City Council/February 26, 2002

-37-
