38. Pines 5'h Addition to Apple Ridge with the developer receiving credit towards trail fees for the trail construction within the Apple Ridge development. Councilmember Hendriksen stated that the Council agreed to use trail fees at the Finance Committee level for a master trail plan, but if they use all of the trail fees for trails within a development they will not be receiving the additional funds to pay for the cost of the master trail plan. Community Development Director Frolik noted that the trail construction within the development would not be credited towards trail fees. Greg Peterson, Oakwood Land Development, stated that they wilt construct the trail within their development at their own cost~:and in addition be charged a trail fee. Mayor Gamec inquired if the City~;~id ;b~ be~:}r of simply collecting the fees and not constructing the trail. Councilmember Henddksen inquired if the tr~l' is not3!~Oing td, r}~onnect to anything why should they construct ~t Community Development Director Frotik noted that the Park Cornrfi~¢ion, is looking at a trail corridor along TH #47 to connect future developments to the so~'~w~:as Elmcrest Park. Councilmember Anderson stated that T.H. ~47 is not hikeabI~ or walkable without a trail. Councilmember Zimmerman stated that he felt the issue needed to be discussed further with the developer. Mayor Gamec replied that it is the City's decision as to whether or not the trail should exist.. City Engineer Olson noted that what was before the Council was preliminary plat approval and will have to come back for final plat approval. Councitmember Hendriksen stated that he would like some research to be done to explain why the trail was not constructed as part of Phase I of Apple Ridge.
