City Attorney Goodrich stated that the Council should be deciding how they want the land to .be
designated and then hold a public hearing on it, rather than the property owner deciding and then
simply the City placing the change on the map. He was concerned that if they allow the property
owner to make the decision they will be setting precedent.

Councilmember Hendriksen stated that he would agree that it is good to have the change
published. If the Council can make a decision on what they want to see On the property and
include it on the map he would agree with that.

City Administrator Norman suggested that the corner at 153rd Avenue and T.H. #47 be
commercial with the remainder of the property being medium density.

Mayor Gamec expressed that the corner might.be another gas station if it is zoned
commercial.

Councilmember
tough shape with the

zone the entire parcel residential then they are in
residential.

Consensus was to have a 1;
remainder designated as medium densi

the east side of T.H. #47 be commercial with

Councilmember Hendriksen stated
Kurak II property. The rezoning would allow
the applicant to build a townhouse development. Edina Development has entered into a purchase
agreement with property owners Herman and Judi Danholz and Ken and Sharon Niles. Edina
Development is requesting the City rezone approximately 25 acres fi.om R-1 Residential, B-1
Business, and B-2 Business to Multiple Residential. Property to the north is zoned R-1
Residential, to the south the zoning is both B-l, Business and R-l, Single Family. To the east
and west the adjacent properties are zoned B-1 and B-2 Business. Over the years, the subject
property has consistently shown up in City comprehensive plans as a place for commercial uses.
The current Comprehensive Plan (1995) identifies this area for commercial and low density

City Council/December 11, 2001

-59-
