-76- <br /> <br />will be required to obtain a permit from the Lower Rum River Watershed Management <br />Organization. The exterior building materials for the building are proposing to consist of <br />rockface and smooth face concrete block, a glass front, and a pre-fin/shed metal canopy. Staff <br />and the Planning Commission are supportive of the proposed accent glass portion of the building, <br />however City Code does not specify that glass is a permitted building material in the BW district <br />and therefore requires City Council approval. The landscaping plan meets City standards. The <br />facility will be served by municipal sewer and water. The Planning Commission recommended <br />approval contingent upon compliance with staff review letter dated July 6, 2001 and revised July <br />20, 2001. <br /> <br />Motion by Councilmember Anderson, seconded by Councihnember Kurak, to approve the <br />proposed site plan for RJM Enterprises contingent upon compliance with City staff review letter <br />dated July 6, 2001 revised July 20, 2001. <br /> <br />Motion can'ied. Voting Yes: Mayor Gamec, Councilmembers Anderson, Kurak, Hendriksen, <br />and Zimmerman. Voting No: None. <br /> <br />Case #7: Acquisition of Land for Well House #3 <br /> <br />City Attorney Goodrich stated that the City has been in negotiations with the property owner <br />where Well House #3 will be constructed. Recently staff and the City Attorney reached a <br />negotiated price for the property acquisition and the matter was discussed in a closed session <br />prior to the Council meeting. <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Kurak, to authorize the City Attorney <br />and the City Administrator to enter into a settlement agreement with the property owner for <br />approximately 2 acres for Well House #3 and pay $100,000 to settle the lawsuit. <br /> <br />Further discussion: Councilmember Hendriksen stated'that $50,000 an acre is unacceptable. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, and Anderson. Voting <br />No: Councilmembers Hendriksen and Zimmerman. <br /> <br />Case #8: Amendments to Ramsey City ~dinance #98-02 (Tobacco Ordinance) <br /> <br />Police Chief Gustafson stated that per the direction received at the July i0, 2001 City Council <br />meeting, staff prepared the amendments to City Ordinance #98-02. The cost of class would be <br />$195 per session. If they hold three classes a year it would cost the City $585 to conduct those <br />seminars. As the tobacco retailers increases the cost of the seminars would not, but the cost of <br />the City Clerk would. All technical equipment needed to conduct the seminars has already been <br />purchased with funds from a Minnesota Department of Health Grant received early in 2001. <br />This equipment should last for several years.
