In the event such waiver is granted, the owner or <br />subdivider shall deposit with the City a sum of money equivalent to <br />the Engineer's estimated cost of the signalization. <br /> <br />Easement Acquisition. Prior to the time of construction, the owner or <br />subdivider shall obtain all easements required for the project. At the <br />time the project is complete and turned over to the City, all easements <br />not dedicated on the final plat shall be deeded to the City in <br />recordable document. 9.50.50 <br /> <br />Lot Grading. All lots shall be graded in accordance with the final <br />grading plan. In addition, erosion control measures shall be followed <br />to eliminate erosion. Upon completion of the grading, topsoil shall be <br />restored and temporary vegetation established. <br /> <br />Trail Development. Trail improvements shall be installed as shown <br />on the final plat and/or master trail plan. All accessible <br />bikeway/walkway trailways shall be constructed of a minimum two- <br />inch (2") bituminous mat on a four-inch (4") gravel base. Grades and <br />specifications shall be as approved by the City Engineer. All paved <br />trailways shall be of an eight-foot (8') width with two-foot (2') graded <br />shoulders. All horse and wilderness trailways shall be graded to a <br />minimum four-foot (4') width and surfaced as determined by the Park <br />and Recreation Commission. <br /> <br />Sidewalks. All subdivisions within the urban service area shall have <br />not less than a five-foot (5') wide concrete sidewalk on at least one <br />side of each through street or anticipated through street to provide for <br />safe pedestrian traffic. Sidewalks may be required on cul-de-sacs. All <br />sidewalks shall be located within the easement area of the road right of <br />way. Wherever possible, placement of the sidewalk within the <br />easement area should allow for a minimum of one foot (1') separation <br />between the edge of one side and the residential property line. The <br />sidewalk shall be constructed as a Stage 1 improvement. Cost of <br />sidewalk construction shall be borne by the developer and not eligible <br />for credit against park and trail dedication fees. The design must meet <br />current standards of the City, comply with the Americans for <br />Disabilities ACT (ADA), and be shown on the preliminary plat for <br />approval. All sidewalks required, by the City shall be constructed of a <br />four-inch concrete placed on a four inch (4") gravel base. <br /> <br />(a) <br /> <br />Maintenance - The City Council annually shall determine the <br />level of snow removal required of adjacent homeowners and to <br />provide for the establishment of a fund to allow for repair or <br />replacement of damaged sidewalks in the future. <br /> <br />9.50 Subdivision Regulations <br /> <br />9-39 <br /> <br />March 2003 Draft <br /> <br />-417- <br /> <br /> <br />
