He <br />noted that the City could draft the contract to indicate the City can stop the project at any point. <br /> <br />City Attorney Goodrich agreed that he could draft a contract to do all or part of the work. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Connolly, to adopt <br />Resolution #00-01-XXX and direct the City Attorney to draft the contract language to allow the <br />City to do all or part of the project. <br /> <br />Further discussion: Councilmember Anderson asked if the City is able to consider a contract that <br />may not be the lowest bid. City Attorney Goodrich stated this is outside of the competitive <br />bidding process, meaning the City can do so and is not legally required to even obtain the second <br />quote. <br /> <br />Motion carried. Voting Yes: Mayor Pro tern Zimmerman, Councilmembers Hendriksen, <br />Connolly, and Anderson. Voting No: None. Absent: Mayor Gamec. <br /> <br />Case #10: December Report from PUblic Works Committee <br /> <br />1) Update on Apple Ridge Drainage <br /> <br />City Attorney Goodrich stated the City did enter into an agreement with Apple Ridge so this is a <br />moot point. <br /> <br />2) Disposition of Surplus Land Acquired for T.H. #47 Highway Project <br /> <br />Councilmember Hendriksen explained that this relates to land obtained to accommodate the T.H. <br />#47 project. Three parcels will have remaining economic value following the necessary fight-of- <br />way and easement dedications. The Public Works Committee recommended that notice of the <br />availability of these parcels be advertised in the City's official newspaper and notification by <br />mail of the availability of the property to adjacent landowners, with the goal of beginning <br />negotiations with interested parties in February. <br /> <br />City Engineer Jankowski advised that the official notice has already been published. <br /> <br />No Council action required. <br /> <br />3) 2000 Street Maintenance Program <br /> <br />City Engineer Jankowski noted the Public Works Committee recommendation on the 2000 Street <br />Maintenance Program has already been addressed by the Council. <br /> <br />City Council/January 25, 2000 <br /> Page 24 of 34 <br /> <br /> <br />
