CASE CONSIDER ENTERING INTO AGREEMENTS WITH MNDOT RELATIVE TO T.H.//47 STP PROJECT By: Steve Jankowski, City Engineer Background: MnDOT has presented the City with two agreements relative to the T.H. #47 STP project. Both ~ agreement§-iire attached. The_~first agreement is Agency Agreement No. 80003, which allows the City to administer the T.~-7 STP project under the Delegated Contract Process. This agreement outlines the responsibilities of the City in administering the contract, the procedure for handling payments, and acknowledges certain Federal, State, and Local laws with which this project must comply. The second ~Partnership Agreement 79780-P. This agreement relates closely to the previous agr~-e~t' it acknowledges MnDOT'S technical partic~ation as the construction engineering and inspection entity on this. project. As a practical matter, this .second agreement designates technical project control to MnDOT o.~ver elements that had been assigned to the City in agreement 80003. The partnership agreement also pledges MnDOT into absorbing the construction engineering costs of the T.H. #47 project, estimated at $256,000. The partnership agreement also acknowledges that MnDOT will be reimbursed for their technical services not associated with the T.H. #47 portion of the project, i.e., Sunwood Drive and City sanitary sewer and water, in the approximate amount of $60,000. It should be noted that both of these agreements contain a cancellation clause which, although may b~°bjectionable, is required by state statutes. ~_ ..~/ Action: Adopt resolutions #00-03-Oxy{ and #00-03-~X authorizing the City to enter into agreements with MnDOT for agreements 80003 and 79780-P respectably.
