Subsequent to the joint meeting, a "Sidewalk Ordinance Committee" met twice to <br />further refine the Ordinance. The attached Ordinance, prepared by Commissioner Dempsey, was <br />approved by the committee for Planning Commission consideration. The Park and Recreation <br />Commission is expected to approve the Ordinance on June 8, 2000. The City Council could <br />introduce the Ordinance at their June 27, 2000 meeting. <br /> <br />Citizen Input <br /> <br />There was none. <br /> <br />Motion by Commissioner Dempsey, seconded by Commissioner Kociscak, to close the public <br />hearing. <br /> <br />Motion Carried. Voting Yes: Chairperson Anderson, Commissioners Dempsey, Kociscak, <br />Johnson, and Wivoda. Voting No: None. Absent: Commissioner Nixt. <br /> <br />The public hearing closed at 8:19 p.m. <br /> <br />Commission Business <br /> <br />Chairperson Anderson called the regular meeting of the Planning Commission back to order at <br />8:19 p.m. <br /> <br />Commissioner Dempsey reviewed the changes made to the ordinance explaining that the main <br />difference with this Ordinance over the one previously presented is that it includes an <br />explanation as to why the City is requiring sidewalks, and it addresses the maintenance concerns. <br />He explained that the Committee reviewed six or seven other city ordinances and all of them, <br />except for Andover, required some type of snow removal in the winter. <br /> <br />Commissioner Johnson inquired if the City Attorney had reviewed the proposed ordinance. <br /> <br />Community Development Director Frolik was unsure if the City Attomey had reviewed the <br />ordinance, but noted he would review the ordinance at the City Council level. <br /> <br />Consensus of the Commission was to change the sentence in Section 2 to read "Sidewalks may <br />be required on a cul-de-sac." <br /> <br />Chairperson Anderson noted that in Section #3 the word "Maintenance" was misspelled. He also <br />stated that in addition to making a recommendation regarding the ordinance, the Commission <br />should forward their opinion regarding maintenance of the sidewalks and snow removal to the <br />City Council. Mr. Anderson was inclined to have snow removal be the responsibility of the <br />homeowner. He also noted that when he was researching City Code, he came across some <br />language regarding penalties to residents for not removing snow from sidewalks.
