70 <br /> <br />Children, Families & Learning that the entity is able to operate the program for the term of the <br />lease. <br /> <br />,Any Use Agreement with an agency operating the program must be for a period of no more <br />than 50% of the useful Life of the facility. If the lease is for a shorter time, or if the lease is <br />terminated, there must be assurances made by the local unit of government that the facility will <br />continue to be used for the purposes identified in the proposal and contract. <br /> <br />The Use Agreement must provide for program oversite by a public officer or agency. A Use <br />Agreement which requires the non-public party to provide to the contracting public officer or <br />agen~ an initial program implementation plan, and, at lease armually, a program evaluation <br />report and a program budget showbg program revenues and expenses, and will be considered <br />to provide for program oversite by a public officer or agency. <br /> <br />Building Requirements <br /> <br />Proposed facilities must satisfy the following requirements: <br /> <br />1. The facilities must provide a physical environment that is responsive to the needs of the <br /> population to be served. <br />2. The facility, at completion of the project, must comply with the Americans with Disabilities <br /> Act (ADA) and all applicable state and local building codes, zoning ordinances, land use <br /> provisions, and laws. <br />3. The facility must be located in Minnesota. <br /> <br />Selection Criteria <br /> <br />Need <br /> <br />The severity of poverty documented in the area where the facility will be located.
