I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br />CASE <br /> <br />ADOPT ORDIIN'ANCE TO AMEND TOWER REGULATIONS <br /> By: Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />On October 24, 2000, the City Council introduced an ordinance to amend the City's tower <br />regulations. The following is a summary oft he Proposed changes to the tower regulations: <br /> <br />· Restrict cell towers on residential property to parcels at least 10 acres in size that are <br /> located in an area to be identified as a Tower Overlay' DiStrict. <br />· Restrict all other towers in t. ke Residential district, generally, to church, park, <br /> government, school, utility, and institutional sites at least 10 acres in size. <br />· Establish a tower setback from adjacent residential dwellings equal to 1.5 times the <br /> height of the tower. <br />· increasing the tower height in residential zones from 75 to 120 feet (designed for at <br /> least 3 antennas). <br />· Co-location radius was increased from ½ mi.le to I mile. <br /> <br />Observations: <br /> <br />Subsequent to Council's introduction of the ordinance on October 24, City Staff determined that <br />some minor text changes were necessary in the ordinance. We needed to clarify that 10 acre <br />parcel sizes should not be required for the placement of antennas on existing towers or structures <br />in any district, or parks adjacent to industrial or commercial uses, provided the antenna does not <br />extend more than l 5 feet above the highest point of. the structure. <br /> <br />When the ordinance was presented to Council on November 14 for final adoption, they directed <br />City Staff to refer the ordinance back to the Planning Commission for affirmation of Staffs <br />modifications to the ordinance draft. On December 5 the Planning Commission reviewed the <br />modifications pertaining to not requiring 10 acre parcel sizes for placement of antennas on <br />existing structures. <br /> <br />Recommendation: <br /> <br />The Planning Commission has recommended adoption of the ordinance as modified by City <br />Staff. ,' <br /> <br />Council Action: <br /> <br />Motion by and seconded by <br />regulations for cell towers. <br /> <br />to adopt Ordinance #00-__ amending the <br /> <br />Roll Call Vote: <br /> <br />Review Checklist: <br />City Attorney <br /> <br />Councilmember Margaret Connolly <br />Councilmember Gerald Zimmerman . <br />Councilmembkr Susan Anderson <br />Councilmember Terry Hendriksen <br />Mayor Thomas Gamec <br /> <br />CC: 121lq/00 <br /> <br /> <br />
